Feiner chinesischer Seiden-Souf-Teppich mit Metallbroschierung

Prächtige Seidenteppiche mit Goldbroschierung aus Peking sind vor allem durch Beispiele mit Inschriften bekannt. Diese
Exemplare werden aufgrund der Inschriften mit dem Kaiserpalast in Verbindung gebracht und erzielen bei Auktionen
regelmäßig sehr hohe Preise. Diese Teppiche folgen fast ausschließlich einem sehr chinesischen Musterrepertoire mit Drachen,
Phönixen, Pferden, Landschaften und Darstellungen von Gebäuden.
Dieser Teppich hat jedoch eine Bordüre, die wir bei Teppichen aus Ostturkestan finden. Drei eckige Blumen, manchmal
in Kästen, die oft auch in Khotan Teppichen vorkommen. Das Feldmuster ist bei Kashgar Teppichen zu finden, hat seinen
Ursprung aber noch weiter westlich in Persien.
Man nimmt an, dass die Metallfaden-Broschiertechnik ihren Weg nach Osten über die so genannten Polonaise Teppiche
gefunden hat, die Anfang des 17. Jahrhunderts in Isfahan hergestellt wurden. Wir finden diese Technik im 18. Jahrhundert in
Kashgar, wo sie von einem chinesischen Reisenden erwähnt wird. Mitte des 19. Jahrhunderts stellten britische Agenten fest,
dass diese Teppiche immer noch verwendet wurden, die Technik aber nicht mehr praktiziert wurde.
In der zweiten Hälfte des 19. Jahrhunderts kam der Metallfaden-Brokat wieder in China an und wurde für sehr luxuriöse
Teppiche verwendet. Im Museum für Angewandte Kunst in Wien befindet sich ein Kashgar Teppich, der im Prinzip die
gleichen Gestaltungsmerkmale aufweist. Eine schräge Dreiblütenbordüre und ein ähnliches Feld im Herati-Stil, wenn auch in
vereinfachter Form. Auch die Nebenbordüren sind verwandt, nur die Perlenbordüre ist eine Anspielung auf eher chinesische
Designtraditionen. Die Farben leuchten wie Juwelen aus den beiden Blautönen, und die Perlen in der Bordüre sind zweifarbig
und nicht einfach blau-weiß.

Sumptuous silk and gold brocaded carpets from Beijing are mostly known through examples which bear inscriptions.
Associated to the Imperial Palace due to the inscriptions these carpets fetch very high prices regularly at auctions.
These rugs follow almost exclusively a very Chinese design repertoire with dragons, phoenixes, horses, landscapes and
depictions of buildings.
This rug however has a border which we find in East Turkestan carpets. Angular three flowers, sometimes in boxes, feature
often in Khotan carpets. The main field pattern appears in Kashgar rugs but originates even further west in Persia.
The metal thread brocading technique is thought to have found its way east from the so-called Polonaise carpets which were
produced in Isfahan in the early 17th century. We encounter the technique in the 18th century in Kashgar where a Chinese
traveller mentions them.
In the mid 19th century British agents noticed that these carpets were still used but the technique was not practised anymore.
In the second half of the 19th century metal thread brocading arrived in China and was used for highly luxurious carpets.
In the Museum of Applied Art in Vienna is a Kashgar carpet which in principle shares the same design features.
Angled three blossom flower border and a similar herati style field albeit in a simplified way.
The minor borders are related as well only the pearl border is a nod to more Chinese design traditions. The colours glow jewel
like out of the two blues and the pearls in the border are two coloured rather than the simple blue and white version.

Wolkenband Kazaks aus den dörflichen Knüpfstühlen rund um Chondoresk im nordwestlichen Teil des Karabagh im
Südkaukasus tragen in der Regel mindestens zwei Medaillons mit diesen schlangenartigen Formen.
Man geht davon aus, dass die Wolkenband- und Sonnenrad-Form von früheren Beispielen in der chinesischen Kunst abgeleitet
ist und in der bildenden Kunst des Irans und der Türkei häufig als abstraktes dekoratives Element verwendet wird.
Hier gibt es jedoch einen Hinweis darauf, dass das Design zu seinem früheren zoomorphen Ursprung zurückkehrt.
Interessant ist, dass die gelben Formen in den oberen und unteren Ecken und die rote Blumenform nur auf einer bestimmten
Anzahl dieser Teppiche vorkommen, die außerdem am oberen und unteren Rand ihrer Felder ein zusätzliches schmales
Schmuckband haben (hier kleine Blumen auf grünem Grund), was darauf hindeutet, dass es sich um eine kleine Gruppe
innerhalb dieser Familie handelt. Der hohe Flor und die tiefen, gesättigten Farben machen diesen Teppich zu einem besonders
guten Beispiel für diese erstaunlich seltene Gruppe von Knüpfarbeiten.

Cloudband Kazaks from the village looms centred around Chondoresk in the northwest part the Karabagh in the southern
Caucasus typically display at least two medallions containing these snake like forms.
The cloudband and pinwheel form are thought to be derived from earlier examples in Chinese art and can often be seen in
the art of Iran and Turkey used as an abstract decorative device, but here there is a hint of the design returning to its earlier
zoomorphic origin.
It’s interesting to note that the yellow forms in the upper and lower corners and the red flower form only appear on a certain
number of these carpets and which also have in the top and bottom of their fields an additional small band of decoration (here
small flowers on a green ground), suggesting that this is a small group within a group.
The rich pile and deeply saturated colours show this to be particularly good example of this surprisingly uncommon group of
weavings.

Dieser außergewöhnliche und wichtige Teppich ist in seinem Zustand vor der Restaurierung in Jürg Rageths bahnbrechendem
Werk über turkmenische Knüpfkunst, Turkmenische Teppiche: Ein neuer Ansatz (Basel, 2016), auf Tafel 27 abgebildet.
Der Teppich war erstmals 1998 von David Reuben publiziert worden; er wurde in beiden Fällen auf das frühe 19. Jahrhundert
datiert. Rageth hat sich sehr bemüht, das Muster einer frühen Tierdarstellung zuzuordnen und es in die sasanische
Designtradition einzugliedern, anstatt einfach zu behaupten, dass es sich um ein florales Muster handelt.
Seine Forschungen weisen das Hauptmotiv eindeutig als Simurgh aus, das mystische Tier, das in iranischen Mythen wie
Ferdowsis Shanama oder “Buch der Könige” erwähnt wird, wo es als zusammengesetzter Vogel mit dem Kopf eines Hundes,
den Füßen eines Löwen und den Flügeln und dem Schwanz eines Pfaus dargestellt wird. Dies symbolisiert die Macht der
Könige, und die stark stilisierte Form hier erinnert auch an die Lotosblume, die häufig als Begleiter in frühen Seiden- und
Keramikarbeiten zu sehen ist.
Die unterschiedliche Bordüre auf der horizontalen und vertikalen Achse findet sich auf den wichtigsten Teppichen aus dieser Zeit.
Die Knüpfwerke der Ersari, die nicht die für turkmenische Stämme typischen Gül-Muster zeigen, wurden von vielen Kennern
oft nicht ernsthaft in Betracht gezogen, aber Rageth war der Meinung, dass dieser Teppich sich in die seit langem bestehende
Kunst- und Knüpftradition der Region einordnet.

This exceptional and important carpet is featured in its pre-restoration state in Jürg Rageth’s seminal work on Turkmen
weavings, Turkmen Carpets: A New Perspective (Basel, 2016), as plate 27.
The carpet had been first published by David Reuben in 1998; it was dated in both places to the early 19th century. Rageth
expended great effort in re-ascribing the design to early animal representation, and within the Sasanian design tradition,
rather than simply suggesting that this is floral design.
His research clearly identifies the main motif as a simurgh, the mystical beast referred to in Iranian myths such as Ferdowsi’s
Shanama or ‘Book of Kings’, where it is shown as a composite bird with the head of a dog, the feet of a lion and the wings and
tail of a peacock. This symbolises the power of kings, and the highly stylised form here also repeats the lotus flower that is
often seen as an accompaniment in early silks and ceramics.
The different border on the horizontal and vertical axes is found on the main carpets from this period.
The weavings of the Ersari that do not depict the typical gül patterns associated with Turkmen tribes have often escaped the
serious consideration of many connoisseurs, but Rageth thought this carpet has securely established these weavings within
the long-established artistic and weaving tradition of the region.

Es gibt zwar viele Beispiele für Teppiche mit rotem Feld und goldoranger Bordüre, aber die Leichtigkeit des Rots und der
pfirsichfarbene Ton der orangenen Bordüre sind höchst ungewöhnlich. Die Bordüre ist bemerkenswert plakativ und aufregend
mit einer S- oder Drachenform, die mit einem gezackten, hakenförmigen Blatt verbunden ist, wie wir es nur auf wenigen
kaukasischen Teppichen finden können.
Das große achteckige Medaillon wird von einem grüngrundigen Memlinggül dominiert, das zwischen zwei rotgrundigen
Sternmedaillons eingebettet ist - ein Gestaltungsmerkmal, das man sonst nur bei Teppichen ohne das rote oder grüne
Hakenkammmuster im Feld findet. Die ungewöhnliche Bordüre und die Farben machen diesen Teppich zu einem
außergewöhnlichen und besonders eindrucksvollen Exemplar dieses bekannten Typs.

What is immmediately striking about this fine and boldly colourful Karachov Kazak is the unusual colour tones of the field and
border as well as the highly graphic motifs in the main border. While there are many examples of carpets with a red field and
golden orange border, the lightness of the red and the peachy tone of the orange border are most unusual.
The border is remarkably bold and exciting with an S or dragon form interconnected with a serrated hooked leaf, which we
can only find on a few Caucasian carpets.
The large octagonal medallion is dominated by a green ground Memling göl sandwiched between two red-ground star
medallion, a design feature that is usually seen in carpets that do not have the red or green hooked comb design in the field.
The unusual border and the colours mark this out as an unusual and particularly striking example of this well known type.

“Jeder weiß, was ein glücklicher Teppich ist”, sagte William Robinson kürzlich in einem Vortrag über die Farben in
safawidischen Kirman Vasenteppichen. Dies trifft sicherlich auf dieses klassische Mudjur Exemplar zu.
Er ist lebendig mit einer Vielzahl von Farben und einer großen Portion Aubergine, die man bei anatolischen Teppichen immer
liebt. Die Zweige eines Strauches in der Mitte wirken bei manchen Exemplaren dieses Typs etwas deplatziert, aber hier
verbinden sie das Feld dank ihrer Vielfarbigkeit erfolgreich mit den traditionellen Bordürensystemen.
Der Stamm des Strauches ist fröhlich regenbogenfarben, ebenso wie die Zwickel über dem Mihrab.
Sogar die Spitzen der pfeilförmigen Blätter sind durch einen einzelnen Knoten in einer anderen Farbe akzentuiert, was den
Eindruck erweckt, dass auch hier eine glückliche Knüpferin am Werk war. Eine Reihe von Nelken umgibt das Feld, wie wir es
von früheren sogenannten “Transsylvanischen” Teppichen in einem naturalistischeren Stil kennen.
Die Leiste über dem Feld stammt ebenfalls von “siebenbürgischen” und noch früheren osmanischen Exemplaren und man
muss schon genauer hinsehen, um die Tulpen zu erkennen, die nach oben zeigen.
Da diese Teppiche entgegen der Musterrichtung geknüpft wurden, ist es nicht verwunderlich, dass an einem Ende halbierte
Bordürenkartuschen zu sehen sind - ein Merkmal, das allen “Siebenbürger” gemeinsam ist, bei denen oft keine einzige
gelungene Ecklösung zu erkennen ist.

‘Everyone knows what a happy carpet is’, William Robinson recently stated in a lecture about colours in Safavid Kerman Vase
carpets. This is certainly true for this classic Mudjur example. It is lively with a great array of colours and a huge amount of
aubergine which one always loves in Anatolian carpets.
The branches of a shrub in the centre, in some examples of the type can feel a bit misplaced but here due to their
multicoloured ness connecting the field successfully with the traditional border systems.
The stem of the shrub is happily rainbow coloured as are the spandrels above the mihrab. Even the tips of the arrow shaped
leaves are accentuated by a single knot in a different colour which makes one think that it was a happy weaver as well.
A row of carnations encircles the field as we know them from earlier so-called ‘Transylvanian’ carpets in a more naturalistic
style. The panel above the field also stems from ‘Transylvanian’ and even earlier ottoman examples and one needs to look
back to recognise the tulips heading towards the top.
As these carpets are woven upside down to the direction of the design one is not surprised to see halved border cartouches at
one end a feature which is shared with all ‘Transylvanians’ where often not a single successful corner solution is found.

In den Katalogbemerkungen des Salor Hauptteppichs, der am 3. Dezember 2002 als Lot 35 in
Fine Antique Oriental Rugs XXXI verkauft wurde, wurde darauf hingewiesen, dass nur 40 Exemplare dieser Teppichart bekannt
sind und dass die Einheitlichkeit der Feld- und Bordürenmuster dieser außergewöhnlichen Teppichgruppe über einen Zeitraum
von 300 Jahren bemerkenswert konstant ist.
Dieses frühe Exemplar weist jedoch einige Unterschiede in Muster und Farbe auf, die es von anderen Exemplaren dieser
Teppichfamilie unterscheiden. Erstens ist die Farbe des Grundes viel heller und leuchtender, was dem Teppich insgesamt eine
weniger düstere Farbpalette verleiht, ein Merkmal, das sich auch in der Verwendung von hellem Grün in den dreiblättrigen
Blüten in den Gülli-Güls und in der Mitte der geviertelten Güls zeigt. Im Inneren der Gülli-Güls befinden sich mehrere kleine
Punktpaare oder Zeichen, die sich immer vertikal und horizontal wiederholen; sie tauchen in einigen Exemplaren dieses
Mustertyps auf, in anderen fehlen sie.
Obwohl sie willkürlich erscheinen, wiederholen sie sich durchgängig in allen Güls und tauchen auch in anderen Teppichen
dieser Gruppe an derselben Stelle auf; was sie bedeuten, ist jedoch unklar.
Die Ergänzung durch kleine Stammesmotive, die auf jeder vertikalen Seite des Feldes aufsteigen, fast wie Markierungen, trägt
dazu bei, den eigenwilligen Charakter dieses prachtvollen Teppichs zu vermitteln.

In the catalogue notes accompanying the Salor Turkmen main carpet sold as Lot 35 In Fine Antique Oriental Rugs XXXI on
3 December 2002, it was noted that only 40 examples of this type of carpet are known, and that the consistency of the field
and border designs of this exceptional group of carpets is remarkably consistent over a period of 300 years.
However, this old example does display several differences in design and colour that mark it apart from other members of this
extended family. First, the colour of the ground is much lighter and brighter, thereby giving the carpet a less sombre overall
colour palette, a characteristic that can also be seen in the use of light green throughout the three petalled flowers in the main
gülli güls and inside the centre of the quartered güls.
Inside the gülli güls are a number of small pairs of dots or marks that are always repeated vertically and horizontally;
they appear in certain groups of this design type but are absent from others. Although these seem random, they are repeated
consistently throughout all the güls and appear in the same place in other carpets of this milieu; however, quite what they
signify is unclear.
The addition of small tribal motifs ascending the field on each vertical side, almost like markers, helps to convey the
idiosyncratic character of this beautiful carpet.

Diese Variante der Karachoph Teppiche, die eher lang und schmal als quadratisch sind, wird manchmal als Gebetsteppich mit
doppelter Nische bezeichnet, da sich an beiden Enden des Feldes zwei scheinbare Gebetsbögen befinden.
Wahrscheinlich handelt es sich aber eher um ein Schlüssellochmuster, das wenig mit dem Gebet zu tun hat, was in diesem Fall
vielleicht durch die vielen Tiere und den Menschen untermauert wird.
Der dichte Flor und die tief gesättigten Farben verkörpern die besten Eigenschaften der Kazak Teppiche, die von Sammlern und
Kennern gleichermaßen bewundert werden. Die Präsenz von 13 Tieren, von denen zwei aus dem Gehege der roten Medaillons
entkommen zu sein scheinen und auf dem grünen Grund grasen, ist ein weiterer Bonus, ebenso wie die Anwesenheit ihres
Besitzers, der am oberen Ende des Teppichs zu sitzen scheint und stolz alles betrachtet, was er unter sich hat.
Es ist erwähnenswert, wie die Knüpferin die inneren Grenzen der beiden roten Medaillons teilweise in ähnlichen Farben wie
den Gebetsgiebeln umrandet hat, um ein Element der visuellen Kontinuität hinzuzufügen.

This variety of Karachov rug which is long and narrow rather than square is sometimes referred to is it double niche prayer
rug, because of the use of two apparent prayer arches at either ends of the field. It is probably more likely that this is simply a
keyhole design with little to do with prayer, a point that is perhaps corroborated in this at instance by the presence of so many
animals and a person.
The rich dense pile and deeply saturated colours epitomise the best qualities of Kazak rugs that are admired by collectors
and connoisseurs alike; the abrashed of the green ground is particularly pleasing. The prescence of 13 animals, two of which
seemed to have escaped the enclosures of the red medallions and are left grazing across the green ground, are a bonus as is
the presence of their owner who seems to sit at the top of the rug and proudly survey all that he owns below him.
It’s worth pointing out how the weaver has partly outlined the internal borders of the two red medallions in similar colours to
the prayer arch in order to add an element of visual continuity.

In Beispielen des Swatiska- oder Sonnenrad-Musters, die keine sekundäre Ornamentik im Feld aufweisen, kann das Muster
manchmal relativ nüchtern und steif wirken, da die weißen Rosetten klar in statischen Reihen angeordnet sind.
In diesem Fall wird die Komposition durch die Fülle kleiner Blüten und kleiner rautenförmiger Formen, die wie kleine
Blütenblätter oder Schneeflocken aussehen, aufgewertet und es entsteht ein Eindruck von Tiefe.
Sie sind in der Tat ein nützliches Gestaltungsmittel, da sie ein Design mit mehreren Ebenen suggerieren und auf das

In examples of the swatiska or pinwheel design that have no secondary decoration in the field, the design can sometimes
seem relatively austere and stiff with the white rosettes clearly appearing in static rows.
Here the profusion of small blossoms and small diamond shaped forms, which look like small petals or snowflakes, enhance
the composition and create a sense of depth. These are indeed a useful compositional tool in that they suggest a
multi-plane design and allude to the interplay between different layers of design in the white blossoms and blue pinwheels.
The proportions of the field design provide enough space for the design elements to interact effectively and allowed the
pinwheels to impart the sense of movement and dynamism that have made this genre so popular with collectors.
The appearance of a nice aubergine purple colour in the border combined with the elements above suggests that this carpet is
slightly older than other examples of this type and definitely dates to the mid 19 century.

Lambalo Kazaks sind seltener als andere Gruppen von Kazak Teppichen aus dem Südwestkaukasus.
Es ist ungewöhnlich, solche Exemplare aus der zweiten Hälfte des 19. Jahrhunderts zu finden, da die meisten Stücke aus dem
20. Jahrhundert zu stammen scheinen und recht ähnliche Formate haben.
Die Farben dieses Teppichs sind außerordentlich klar, und der Knüpferin ist es gelungen, eine große Anzahl von Rot-, Blauund Grüntönen zu erzeugen, indem sie eine unterschiedliche Anzahl von Färbebädern verwendete und auch mit anderen
Farbstoffen überfärbte.
Die Wiederholung der floralen Rosetten im Feld und in der Hauptbordüre ist besonders reizvoll. Die Bordürensysteme sind
typisch für Lambalo Teppiche und tragen dazu bei, den Teppich in der Kazak Region anzusiedeln, allerdings mit Einflüssen aus
dem Talish und Gendje Gebiet.

Lambalo Kazaks are a less common than other groups of Kazak rugs from the southwest Caucasus.
It is unusual to find examples from the second half of the 19th century such as this since most examples seem to date from the
20th century, and have quite similar formats.
The colours of this rug are excpetionally clear and the dyers managed to achieve a great number of tones of red, blue and
green from using a differing number of dye baths and also overdyeing with other dyes.
The repetition of the floral rosettes in the field and main border is particularly pleasing. The border systems are typical of
Lambalo rugs and help to locate the rug in the Kazak region but with influence from Talish and Genje area weavings.

Stefano Ionescu (Antique Ottoman Rugs in Transylvania, 2005) unterteilt den großen Bestand an türkischen, vor allem
westanatolischen Exportteppichen, die in rumänischen Kirchen und Museen überlebt haben, in vier verschiedene
Mustergruppen, von denen die zahlenmäßig größte die mit Variationen des Doppelnischenmusters ist, das auf der vertikalen
Achse symmetrisch ist.
Dieser rotgrundige “ Transsilvanier “, in gutem Zustand, untypisch farbenfroh und gut kontrastiert mit guten Blau- und
Grüntönen, zeigt eine symmetrische Anordnung von floralen Motiven, die die zentrale Fläche bedecken, die durch
einen wechselseitigen inneren “Widderhorn” Schutzstreifen abgegrenzt ist. In den Zwickeln befinden sich Saz-Blatt- und
Palmettenmotive, die alle von einer Stern- und Kartuschen-Hauptbordüre umschlossen sind.
Die Hauptbordüre befindet sich ebenfalls auf rotem Grund und nicht in einer kontrastierenden Farbe und wird ihrerseits von
einem klassischen wechselseitigen äußeren Dreiblattstreifen geschützt. Nach gängiger Auffassung ist die Bordüre mit zwei
verschiedenen Elementen, der Kartusche und dem achteckigen Stern, älter als die mit der Kartusche allein.
Hier sind die gut durchdachten primären Palmettenmotive auf der vertikalen Mittelachse eine attraktive Variante der
stilisierten hängenden Moscheelampen, die in vielen verwandten Teppichen zu sehen sind.
Die typischen Rosetten- und Saz-Blatt-Zwickel, die bei den meisten ähnlichen Beispielen ein dunkles Feld und helle ZwickelFarbschema aufweisen, sind hier in einer stark abraschierten Kombination aus Blau, Grün und Gelb wiedergegeben.

Stefano Ionescu (Antique Ottoman Rugs in Transylvania, 2005) divides the large corpus of Turkish, primarily west Anatolian,
export rugs that have survived in Romanian churches and museums into four different design groups, the numerically largest
being those with variations on the double-niche design, which is symmetrical on the vertical axis.
This red-ground ‘Transylvanian’, in good condition and uncharacteristically colourful and well contrasted with good blues and
greens, shows a symmetrical arrangement of floral devices covering the central reserve defined by a
reciprocal ‘ram’s horn’ inner guard stripe, and saz leaf and palmette motifs in the spandrels, all enclosed within an star and
cartouche main border, also on a red ground rather than in a contrasting colour, and itself guarded by a classical reciprocal
trefoil outer stripe.
Conventional wisdom holds that the border with two different elements, the cartouche and octagon-star, is earlier than
that with the cartouche alone. Here the well-conceived primary palmette motifs on the central vertical axis are an attractive
variation on the stylised pendant mosque lamps seen in many related rugs.
The typical rosette and saz leaf spandrels, which in most parallel examples exhibit a dark field-light spandrel colour scheme,
are here rendered in a heavily abrashed combination of blue, green and yellow.

Melas mit Säulenmuster sind Teil der Entwicklung der Melas Teppiche in der zweiten Hälfte des 19. Jahrhunderts, als sich die
Design Elemente des traditionellen osmanischen Geschmacks an eine neue, westlichere Ästhetik anpassten.
Dieses Muster ist überraschend wirkungsvoll und doch einfach, denn es besteht aus zwei Bordüren um ein Feld mit Säulen,
die selbst wie Bordüren aussehen und von einem violetten und gelben Zackenmuster umgeben sind. Interessant ist, dass die
zentrale Säule des Teppichs ein anderes Muster aufweist und einen halb roten und halb blauen Grund hat.
Der Kontrast zwischen der schwarz umrandeten aufsteigenden Ranke und den kleinen flachen Elementen, die nicht umrandet
sind, trägt dazu bei, dem Feldmuster Tiefe und Bewegung zu verleihen.
Der Zustand der Farben und des Flors ist für einen Teppich dieses Alters außergewöhnlich.

The column design Melas are part of the development of Melas rugs in the second half of the 19th century as designers were
adapting items of traditional Ottoman taste into a new more westernised aesthetic.
This design is surprising effective yet simple as it has two borders around a field design of columns, that appear to look like
border designs themselves, all enclosed within a purple and yellow sawtooth guard.
It’s interesting that the central column of the rug uses a different design and has a half red and half blue ground.
The contrast between the black outlined ascending vine and the small flat elements that are not outlined helps to add depth
and movement to the field design. The preservation of the colours and pile is exceptional for a rug of this age.

Die dichte Knüpfung - tief gesättigte Farben, violett-braun und bläulich-grün lässt dieses farbenprächtige Knüpfwerk dem
Unterstamm der Igdir innerhalb der größeren Gruppe der Yomuden zuordnen.
Obwohl Okbash eher selten auf dem Markt auftauchen, ist es besonders ungewöhnlich, Exemplare mit derartiger Farbtiefe
und -vielfalt wie dieses zu finden.
Außerdem kennen wir ein so seltenes Feldmuster nur von zwei oder drei veröffentlichten Beispielen, obwohl es auch auf
kleinen Mafrasch oder kleinen Spindeltaschen dieses Stammes zu finden ist.
Diese Taschen hatten keine Rückseiten und wurden in zylindrischer Form zusammengenäht, um die Zeltstangen zu halten,
während der Stamm auf Wanderschaft war.
Sie schützten die Kamele vor Kopf- und Halsverletzungen, wenn die Familien von einem Ort zum anderen zogen.
Ihre Funktion ist daher sowohl dekorativ als auch funktional - sie sind typisch für die Erzeugnisse der turkmenischen Stämme
im Allgemeinen.

The dense weave – deeply saturated colors, purplish-brown, blueish green – helps to place this beautifully colourful trapping
within the Igdir subtribe within the wider Yomut weaving family.
While Okbash do appear in the market infrequently, it is particularly unusual to find examples with the depth and variety of
colour of this example. Furthermore, we know this rare field design from only two or three published examples, though it can
also be found on small mafrash or small spindle bags made by this tribe.
These bags never had back panels and were sewn together in a cylindrical form and used to hold the tentpoles while the tribe
was on migration.
They would have protected camels from hurting their heads or necks when families were moving between locations.
Their function is therefore both decorative and functional – in fact they are an apt metaphor for the woven products of the
Turkmen tribes in general.

Ein ähnlicher Seychour mit Vasenmuster, der ein abstrakteres Muster aufweist, wurde von Mike Tschebull in “Qarajeh to
Quba” (London, 2019) veröffentlicht und auf 1277 AH/1860 CE datiert.
Beispiele aus dieser kleinen Gruppe langer Teppiche zeigen in der Regel drei Vasen, aus denen Gruppen roter und grüner
Blumen herauswachsen, immer eingefasst von der weiß-blauen “Laufender Hund-Bordüre”, die dadurch eng mit Teppichen
aus dem Nordostkaukasus verbunden ist. Der Ursprung des Musters wird auf den Einfluss bedruckter Baumwollstoffe
zurückgeführt, die von der Britischen Ostindien-Company in der Region verbreitet wurden, die entweder aus Indien importiert
oder in Großbritannien selbst hergestellt wurden.
Auch könnte es (wie Ian Bennett vorschlägt) auf den verbleibenden Einfluss des Teppichdesigns der Safawiden zurückgeführt
werden, insbesondere auf die Vasenteppiche aus Kerman aus dem 16. und 17. Jahrhundert. Die große Vielfalt an natürlichen
Farben im Vergleich zu dem zuvor zitierten Beispiel hilft uns, diesen Teppich in die Mitte des 19. Jahrhunderts zu datieren.
Dass dieser Teppich in einer dörflichen Umgebung geknüpft wurde, verdeutlicht die seltsame Zugabe eines weiteren Musters
am oberen Ende des Feldes, das völlig losgelöst vom Rest des Teppichmusters ist - ein Muster, das normalerweise in der
Bordüre eines anderen Teppichs aus dem Kuba-Distrikt zu finden ist.

A vase-design Seychour rug, with a more abstract design, was published by Mike Tschebull in Qarajeh to Quba (London, 2019)
and is dated 1277 AH/1860 CE.
Examples from this small group of long rugs usually show three vases, out of which grow groups of red and green flowers,
always contained within the white-and-blue running-dog border that is so closely associated with rugs from
northeast Caucasus.
The origin of the design has been variously traced to the influence of printed cottons distributed throughout the region by the
British East India company, cottons either imported from India or produced in Britain itself, or (as Ian Bennett suggests) it can
be traced to the remaining influence of Safavid carpet design and in particular the 16th- and 17th-century vase carpets from
Kerman.
The great variety of natural dyes, in comparison with the previously cited example, helps us to date this rug to the mid-19th
century. That this rug was woven in a village setting is made clear by the odd addition of another pattern at the top of the field,
totally disconnected from the rest of the rug design – a pattern that normally would be found in the border of another type of
rug from the Kuba district.

Während eines Großteils des 19. Jahrhunderts war die Region Seychour im Nordosten des Kaukasus weit vom inneren
Kaukasus entfernt, aber offen für äußere Einflüsse, die vom Kaspischen Meer her kamen.
Das ist vielleicht der Grund, warum es so viele kleine Gruppen von Teppichen mit einzigartigem Design gibt, die dieser Region
zugeschrieben werden.
Durch Einflüsse von der Kaspischen Küste bis hin zu Aufträgen aus Russland haben die Dörfer und Werkstätten oft Muster aus
anderen Bereichen übernommen.
Dieses Muster ist nicht weithin bekannt, und in der Literatur sind keine Vergleiche zu finden, aber es ist von einem
Medaillonmuster abgeleitet, das auf Sumakhs verwendet und dann im Zuge der Expansion der Produktion durch die Russen zu
einem einzigen Medaillonmuster weiterverarbeitet wurde.
Die Verwendung einer breiten Palette natürlicher Farbstoffe, darunter Goldgelb und Aubergine, bezeugen das Alter und die
hohe Qualität des Teppichs.

For much of the 19th century the Seychour region of the northeast Caucasus was remote from within the Caucasus, yet open
to external influences coming in from the Caspian.
That is perhaps why there are so many small groups of unique-design rugs attributed to it. Through influence from the coast to
commissions from Russia, the villages and workshops often adapted designs from other media.
This design is not widely known, and no analogues are published in the literature, but it is adapted from a medallion design
used on sumakhs and then further adapted under the expansion of production by the Russians into a single medallion design.
The use of a wide range of natural dyes, including golden yellow and aubergine, shows the age and high quality of the rug.

Eine große Anzahl von Gebetsteppichen wird Konya zugeschrieben, und innerhalb dieser großen Gruppe ist es oft schwierig,
Teppiche mit größerer Gewissheit zuzuordnen. In diesem Fall deuten jedoch Knüpfung, Größe, Farbe und Format des
Gebetsgiebels auf eine Knüpfung in Konya hin, während einige der Mustermerkmale eine Zuschreibung in Richtung der Stadt
Ladik nahelegen, die nur wenige Kilometer nördlich von Konya liegt.
Insbesondere die Tulpen zwischen zwei geschwungenen Blättern, die sich mit mehrfarbigen Rosetten abwechseln, ist eine
Bordüre, die eng mit den Gebetsteppichen von Ladik assoziiert wird. Die Tulpen sowohl im Feld als auch direkt über dem
Gebetsgiebel scheinen ebenfalls von derselben Gruppe von Gebetsteppichen beeinflusst zu sein.
Wenn man diese Muster mit den kräftigen und fröhlichen Farben der Konya-Teppiche kombiniert, wird aus der manchmal
etwas gedämpften Farbgebung von Ladik ein Teppich mit einzigartigem Charakter.

A great number of prayer rugs are attributed to Konya and often within this large grouping it is difficult to attribute rugs with
any greater degree of certainty.
However, in this instance while the weave, size, colour and format of the prayer arch indicate a Konya weaving some of the
design features suggest an attribution closer towards the town of Ladik, just a few miles north of Konya.
Specifically, the tulips between two curved leaves alternating with polychrome rosettes is a border closely associated with the
prayer rugs of Ladik, and the tulips both in the field and sitting up right above the prayer arch also seemed to be influenced by
the same group of prayer rugs.
Seeing these designs articulated with the strong and cheerful colours associated with Konya rugs however transports this from
the sometimes more subdued colouring of Ladik into a rug of unique character.

Saryk Hauptteppiche mit dem abgerundeten Tschowal-Hauptgül, das sich dann als Nebengül wiederholt, sind die häufigsten
der vier Typen von Saryk Hauptteppichen. Sie sind eine relativ geschlossene Gruppe und zeigen, dass es sich um eine lange und
gut etablierte Tradition handelt.
Während die Feinheit der Knüpfung, die Leuchtkraft der rubinroten Grundfarbe und die Proportionen der Feldkomposition für
den Kenner die wichtigsten Kriterien für die Qualitätsbeurteilung sind, können kleine Abweichungen das Gewicht eines solchen
Arguments erhöhen. In diesem Beispiel gibt es eine Reihe verschiedener Muster in der Mitte des Güls, die vom StandardKreuzmuster bis hin zu einer Hakenraute reichen, und ganz ungewöhnlich ist auch eine Reihe, in der ein ausgefallenes
Stammeszeichen einfach frei in der leeren Mitte des Güls schwebt.
Darüber hinaus gibt es viele kleine Nebenmuster, die das Feld vertikal zwischen den kleinen Güls schmücken, die kleinen
Nebenbordüren sind bisher auf keinem anderen Teppich dieser Gruppe zu finden. Diese Variationen machen diesen Teppich

Saryk main carpets that have the rounded chuval major göl which is then repeated as the minor göl are the most numerous of
the four types of Saryk main carpet.
They are a relatively cohesive group and show that this is a long and well established tradition. While fineness of weave, the
lightness of the ruby red ground colour and the proportions of the field composition are the major touchstones for judging
quality for a connoisseur, small variations can be used to add weight to any such judgement.
In this example there are a number of different designs used in the centre of the göls, ranging from the standard cross design
through to a hooked diamond and most unusually there is also a row where an eccentric tribal device simply floats free in the
empty centre of the göls.
In addition there are lots of small tertiary designs decorating the field vertically between the minor göls, and the minor
borders haven’t yet been found on any other carpet of this group. These variations make this an atypical example of this group
and full of character, and arguably make it one of the best examples to have come on the market for some years.

Der Name “Adler-Gül” wurde erstmals in der ersten Publikation über die Teppiche der turkmenischen Stämme von General
Bogoljubow aus dem Jahr 1908 verwendet, in der er die Form des Hauptgüls als an die Flügel eines Adlers erinnernd
beschrieb. Die Teppiche und Trappings, die heute als Adler-Gül-Gruppe bekannt sind, wurden in “Kultur der Turkmenen” von
Rautenstengel und Azadi 1990 endgültig in drei Gruppen eingeteilt, die auf ihrer Struktur basieren.
Dieser Teppich war eine der wenigen Abbildungen in dem Buch und wurde als Paradebeispiel für Teppiche der Adlergruppe
II verwendet, mit Schüssen aus Wolle und Baumwolle, asymmetrischen Knoten, die nach rechts offen sind, und vier Reihen
von Adler-Güls, die durch drei Reihen von Dyrnak-Güls geteilt werden. Es handelt sich auch um eines der wenigen Exemplare,
bei denen die horizontalen Bordüren das vertikale Muster der so genannten “Schiffchenbordüre” beibehalten und nicht mit
floralen Mustern versehen sind; dieses Merkmal findet sich auch bei Teppichen der Gruppe I, die als älter gelten.
Es sind weniger als zwanzig Exemplare dieses Teppichdesigns bekannt und sie kommen nur selten auf den Markt, insbesondere
mit einer so renommierten Provenienz.

The name ‘Eagle’ gül was first coined in a passing reference in the first publication on the carpets of the Turkmen tribes by
General Bogolyubov in 1908, in which he described the shape of the main gül as resembling an eagle’s wings.
The carpets and trappings now known as the Eagle gül group were definitively placed into three groups, based on structure, in
Kultur der Turkmen by Rautenstengel and Azadi in 1990. This carpet was one of the few illustrations in the book and was used
a prime example of Eagle group II carpets, with wool and cotton wefts, asymmetric knots open right and four rows of eagle
güls divided by three rows of dyrnak güls.
This is also one of the few examples in which the horizontal borders maintain the vertical, so-called ‘boat border’ design
rather than adopting floral designs; this characteristic is also a feature of group I carpets, which are considered older.
There are fewer than twenty examples of this carpet design known, and they rarely come onto the market, especially with
such a prestigious provenance.

Dieses Teppichfragment weist die strukturellen Merkmale und das charakteristische Feldmuster auf, die mit den
Hauptteppichen der Adlergruppe II assoziiert werden, zeigt aber auch Eigenheiten, die für den Kenner von großem Interesse
sind. Erstens unterscheiden sich die Proportionen des Feldes von denen vieler anderer Exemplare dieser Gruppe, da die Höhe
der Güls unterschiedlich ist und alle drei Gül-Arten das gleiche Gewicht und die gleiche Ausprägung zu haben scheinen.
Dies deutet auf eine frühe Datierung hin, da in anderen, möglicherweise späteren Exemplaren das Adler-Gül mehr Platz um
sich herum hat und definitiv die prominenteste Komponente des Felddesigns zu sein scheint.
Tatsächlich hat das Adler-Gül eine etwas andere Innengestaltung, was darauf hindeuten könnte, dass es sich hier um eine
Darstellung des Designs im Umbruch handelt. Interessanterweise scheinen die Bordürenmuster in allen Teppichen der AdlerGül-Gruppe einzigartig und in allen anderen turkmenischen Knüpfungen äußerst selten zu sein.

This carpet fragment has the structural characteristics and field design associated with Eagle group II main carpets, but also
shows idiosyncrasies that are of great interest to the connoisseur. First, the proportions of the field are different from those
of many other examples in this class, since the height of the güls is different and all three güls types seem to have the same
weight and prominence.
This implies an earlier dating, since in other potentially later examples the eagle gül has more space surrounding it, and
definitely seems to be the most prominent component of the field design. In fact, the Eagle gül has a slightly different internal
design, which may suggest that this is a view of the design in transition. Interestingly the border designs seem to be unique in
all of the Eagle gül-group carpets, and extremely rare in all other Turkmen weavings.

Die Vielfalt der Muster und Farben auf diesem Ensi aus dem frühen 19. Jahrhundert macht ihn nicht nur zu einem
ungewöhnlichen, sondern auch zu einem besonders fröhlichen Exemplar. Viele der Elemente sind von Ensis bekannt, die in der

The variety of designs and colour on this early 19th-century ensi make it not only an unusual example but also a particularly
cheerful one. While many of the elements are known from ensis that were made in the northeast Caspian region, it is rare to
see them combined in this manner.
These include the polychrome rows of forked devices separating out the blue-green, two-headed branch forms in the field,
the ashik patterns with additional layers of serrations in the white-ground border.
The most notable features though are the tall, elegant and totemic ashik trees in the lower elems.

Dieses noch unpublizierte Trapping ist ein seltener Neuzugang in der Kategorie Adlergül Gruppe I. Es zeichnet sich dadurch
aus, dass in einem der Schussfäden Wolle und Seide zusammen verwendet werden und dass die Knüpfung, die asymmetrisch
und nach links offen ist, dreifädig ist und nicht wie sonst üblich aus zweifädiger Wolle besteht.
Von besonderem Interesse ist die Verwendung von vier Güls, die die horizontale Achse des Feldes ausfüllen, sowie die
großzügigen Proportionen dieser Güls.
Zwar gibt es eine Reihe von Trappings, die diese beiden durch die obere und untere Bordüre abgeschnittenen Güls darstellen,
doch sind die Proportionen der Feldgestaltung hier besonders ungewöhnlich und auffällig. Interessant ist auch, dass sich
die Form der Güls zwischen den einzelnen Exemplaren beträchtlich ändert, ebenso wie das Auftreten verschiedener
Sekundärmotive; hier tragen die Chemche-Güls sowie der Kochanak in jeder Bordüre dazu bei, unmittelbare Vergleiche mit
Tekke Torben zu ziehen.
Die innere Zeichnung der Güls mag mit anderen Stücken dieser Art übereinstimmen, aber die abgerundeten Kanten und ihre
Höhe heben dieses Exemplar von allen anderen ab.

This unpublished trapping is it rare addition to the Eagle gül group I category. It is distinguished by having wool and silk applied
together in one of the wefts, having 3-ply rather than the more typical 2-ply wool used in the knotting, which is asymmetric
and open to the left. Of particular interest is the use of four güls to fill the horizontal axis of the field as well as the generous
proportions of these güls.
While there are a number of trappings depicting these two chuvals cut off by the upper and lower borders, the proportions
of the field decoration here are particularly unusual and striking. Is also interesting that the shape of the güls changes
considerably between examples, as well as the appearance of different secondary motifs; here the chemche güls, as well as
the kochanak in each border, help to draw immediate comparisons to Tekke torbas.
The internal drawing of the güls may be consistent with other trappings of this design, but the rounded edges and indeed their
height set this one apart from all others.

Die kleine Gruppe von Teppichen mit diesem Feldmuster hat die Aufmerksamkeit von Autoren und Kennern gleichermaßen
auf sich gezogen, damit sind Beispiele in einer Reihe von Publikationen erschienen. Während dieser Teppich von Uwe Jourdan
in Oriental Rugs, Vol. 5 (1989, S. 162) veröffentlicht wurde, wurde ein sehr ähnlicher Teppich von Mackie und Thompson in
Turkmen (“Washington, 1980, Tafel 66”) veröffentlicht, der sich im Fogg Art Museum der Harvard University befindet.
Das Abdal-Gül-Muster gehört zur breiteren C-Gül- und Yomut Familie und ist eine Variante, die nur in Teppichen aus der ersten
Hälfte des 19. Jahrhunderts auftaucht und dann zu verschwinden scheint.
Die diagonalen Reihen von Güls, die in farblicher Reihenfolge angeordnet sind, verleihen dem Muster eine Dynamik, die in

The small group of carpets showing this field design has attracted attention from authors and connoisseurs alike, and
examples have appeared in a number of publications. While this carpet was published by Uwe Jourdan, in Oriental Rugs, Vol.
5 (1989, p. 162), a very similar carpet was published by Mackie and Thompson in Turkmen [Washington, 1980, plate 66) That
belongs to the Fogg Art Museum at Harvard University. The Abdal göl design belongs to the wider C-gül and Yomut family and
is a variant that appears only in carpets from the first half of the 19th century and then seems to disappear.
The diagonal rows of güls arranged in colour order gives the design a dynamism that in this example is enhanced by the
strongly abrashed brown ground and the striking use of white indentations in the güls, accentuating the pattern and imparting
an electric quality to the whole field design.
It is also worth noting the size of the elem panels at either end of the carpet, which are much more generous than in most
examples and therefore allow the tree design to become a fully articulated pattern.

Inschriften entweder in einem Streifen an einem Ende oder in Kartuschen. Diese signierten Teppiche stellen ein äußerst
interessantes, vielleicht sogar einzigartiges soziales und künstlerisches Zeugnis einer der bemerkenswertesten Episoden der
iranischen Geschichte in den letzten anderthalb Jahrhunderten dar - dem Aufstieg und Fall der Großkhane der Bachtiaren.
Die Teppiche wurden in dörflichen Werkstätten hergestellt, die der Stammesaristokratie gehörten oder von ihr gefördert
wurden und im Kernland des Chahâr Mahal-Tals in der Nähe von Isfahan angesiedelt waren.
Fast alle Inschriften, die aus den Namen, Titeln und Ehrentiteln bestimmter Khans bestehen und in der Regel auch ein Datum
zwischen den 1880er und 1920er Jahren enthalten, weisen darauf hin, dass sie für oder von den namentlich genannten
Bachtiari-Stammeskhans in Auftrag gegeben wurden. Das Zeichen des Mäzens, das im Farsi-Ausdruck “farmayesh”
(im Auftrag von), gefolgt vom Namen eines Khans, enthalten ist, bedeutet nicht unbedingt, dass der Teppich für den
ausschließlichen Gebrauch dieses Khans geknüpft wurde.
Einige Exemplare können als posthume Huldigung in Auftrag gegeben worden sein. Eine umfassende Darstellung der BachtiariKhan-Teppiche findet sich in dem zweiteiligen Artikel von Ian Bennett aus dem Jahr 1989, “Carpets of the Khans”, in HALI 43
und HALI 44. Stilistisch hat dieser Medaillonteppich, der 1894 im Auftrag von Soltan Morad Khan Bakhtiari hergestellt wurde,
bestimmte Elemente mit einem nicht signierten und etwas jüngeren Teppich gemeinsam, der von dem 2022 verstorbenen
Peter Willborg in seinem Buch “Chahâr Mahal va Bakhtiâri. Village, Workshop and Nomadic Rugs of Western Persia”, Nr. 148,
der dem Dorf Chahâr Mahal von Farâh Donbeh zugeordnet wird.

A considerable number of imposing late 19th and early 20th century Bakhtiari carpets bear ornate inscriptions either in a strip
at one end or in cartouches. These inscribed carpets represent an extremely interesting, perhaps unique, social, and artistic
record of one of the most remarkable series of events of Iranian history during the past century and a half – the rise and fall
of the Great Khans of the Bakhtiari – having been made village workshops owned or patronised by the tribal aristocracy set up
within the tribal heartland of the Chahâr Mahal Valley, near Esfahan.
Almost all the inscriptions, consisting of the names, titles and honorifics of particular khans, and typically also including a date
sometime between the 1880s and 1920s, indicate that they were commissioned for or by the individually named Bakhtiari
tribal khans. The sign of patronage, contained in the Farsi term farmayesh (‘by order of’) followed by the name of a khan, does
not necessarily mean that the rug was woven for that khan’s exclusive use, and some examples may have been commissioned
in posthumous tribute.

Es gibt viele verschiedene Muster für Melas Teppiche, von denen die meisten bis zu einem gewissen Grad auf andere
anatolische Knüpftraditionen verweisen. Dieser Designstil wird jedoch entweder Barock oder Mejideh genannt und gehört zu
den Innovationen, die Mitte des 19. Jahrhunderts auf den Webstühlen von Melas eingeführt wurden.
Mejideh ist nach Sultan Abdul Mejid (1839-1861) benannt, der den osmanischen Geschmack und Dekorationsstil ablehnte und
das türkische Design europäisieren wollte. Er baute den Dolmabahce Palast am Bosporus in Istanbul, inspiriert von seiner Liebe
zu allem Französischen, insbesondere zu Versailles.
Die Verwendung eines neuen Farbkonzepts, neuer gefiederter Blätter, angedeuteter Bögen anstelle offensichtlicher
Gebetsnischen und das Fehlen schwarzer Umrandungen kennzeichnen den Stil, der in diesem eleganten Teppich deutlich zur
Geltung kommt. Das Zusammenspiel der verschiedenen Farben im Fond ist besonders auffällig, ebenso wie die Stärke und
Klarheit des Gelbs in der Bordüre, das nach mehr als 150 Jahren noch immer bemerkenswert unverändert ist.

There are many different design types for Melas rugs, most of which refer to some extent to other Anatolian weaving
traditions. However this style of design is called either Baroque or Mejideh and are one of the innovations introduced to the
looms of Melas in the mid-19th century.
Mejideh is named after Sultan Abdul Mejid (1839-1861), who rejected Ottoman taste and decorative style and wanted to
Europeanise Turkish design, and who built Dolmabahce Palace on the Bosphorus in Istanbul inspired by his love all things
French and in particular Versailles. T
he use of a new colour scheme, new feathered leaves, implied arches rather than obvious prayer niches and a lack of black
outlining characterises the style, all of which are clearly at use in this elegant rug. The interplay of different colours in the
ground is particularly striking as is the strength and clarity of the yellow in the border which has remained remarkably resilient
to fading after more than 150 years.

Darstellungen von Tigerfellen auf Teppichen und anderen Textilien sind in ganz Asien zu finden und reichen mindestens ein
paar tausend Jahre zurück. Frühe Teppiche, die in der Taklamakan Wüste gefunden wurden, gehören zu diesen Teppichen,
auch finden wir sie auf chinesischen Gemälden.
Die frühesten nicht archäologischen Teppiche stammen aus dem späten 17. Jahrhundert, und es sind viele weitere aus dem
19. Jahrhundert bekannt. Einige zeigen nur abstrakte Streifen, andere Tiger, die zwischen Bambus laufen, wieder andere
sind eindeutig Felle. Trophäen, die den Besitzer als einen mächtigen Mann zeigen. Die Markierung des Rückgrats findet
sich in Beispielen, die lediglich Tigerstreifen in verschiedenen Formen zeigen, ist aber bei den Fellteppichen seltener. Die
Akzentuierung der Beingelenke mit Wirbeln findet sich in beiden Gruppen.
Dieser Tiger scheint gut genährt und auch sein Gesichtsausdruck ist nicht sehr furchteinflößend. Die blaue Schnauze, die
Augenbrauen und der Schwanz sind zweifarbig gezeichnet, nicht unähnlich der “Pfeffer und Salz”-Knüpfung, die wir bei diesen
Teppichen finden, aber hier ist sie in Reihen von blauem und weißem Flor geknüpft.
Das Braun ist stark korrodiert, wie es bei Teppichen aus der Kang Xi-Zeit häufig vorkommt, die weiße Unterbauchkontur ist am
besten erhalten. Eberhart Herrmann veröffentlichte 1980 in Seltene Orientteppiche III Nr. 122 ein Exemplar, das in der Form
eines Fells aus dem 18. Jahrhundert gleicht. Obwohl dieser Tiger schlanker war, hat er ein freundliches Gesicht mit einer blauen
Nase und auch die Gelenke seiner Hinterbeine zeigen Wirbel.

Depictions of tiger pelts on carpets and other textiles can be found throughout Asia and extend back at least a couple to
thousand years. Early carpets found in the Taklamakan dessert belong to them but we find them on Chinese paintings as well.
The earliest non archeological carpets are from the late 17th century and many more from the 19th century are known.
Some show just abstract stripes, others tigers walking among bamboo others are clearly pelts.
Trophies which shows the owner as a powerful man. Marking the backbone is found in examples which just tiger stripes of
various forms but is rarer among the pelt rugs.
The accentuation of the leg joints with swirls is found in both groups. This tiger seem well fed and also his facial expression
is not very fearsome. The blue snout, the eye brows and the tail are woven in two colours not unlike the ‘pepper and salt’
knotting we find in these rugs but here it is done in rows of blue and white pile. The brown is heavily corroded as it happens
often in Kang xi period rugs the white under belly outline preserved the best. Eberhart Herrmann published 1980 in Seltene
Orientteppiche III no 122 an example which is in the shape of a pelt dated to the 18th century.
Even though that tiger was slimmer it has a friendly face with a blue nose and his hind leg joints show swirls as well.

Die Bedeutung des persischen Wortes Kalemkar ist ein mit einem Federkiel oder Pinsel gezeichnetes oder gemaltes Werk. Sie
wurden in Persien und Indien in einer Mischung aus Malerei, Druck und Resistfärbung hergestellt.
Die meisten zeigen geometrische und Blumenmotive, oft in einer Nische oder mit einem Medaillon.
Seltener sind Darstellungen von Menschen, die Erzählungen aus der Geschichte, Schlachtszenen und romantische Gedichte
wiedergeben. Während der Quadjar-Dynastie gab es keine Beschränkungen für die Darstellung von Personen.
Das Feld ist vollständig bemalt, während die Bordüren gedruckt und mit Resist gefärbt sind.
Die Bordüre ist bei diesem Exemplar besonders aufwendig gestaltet und zeigt wilde Tiere, Gebäude und Menschen und geht
auf die Bildtraditionen der Safawiden zurück. Auf dem Feld entspannt sich eine Dame auf einer Liege mit Knöpfen und der
Künstler schafft es den Eindruck von glänzendem Leder zu vermitteln.
Es ist interessant, die Textilien zu betrachten, die innerhalb des Textils gezeigt werden. Qalamkari wurden verwendet
um Geschichten zu erzählen und hingen an den Wänden von Kaffeehäusern oder wurden von Geschichtenerzählern auf
öffentlichen Plätzen gezeigt. Die Zahl zwei auf der Oberseite deutet darauf hin, dass es zu einer Reihe von mehreren Qalamkari
gehörte, die jeweils ein anderes Kapitel der Erzählung beleuchteten.

The meaning of the Persian word Qalamkar is a work drawn or painted with a quill or brush. They were produced in Persia and
India with a mix of painting, printing and resist dyeing.
Most show geometric and flower motifs often in a niche or with a medallion. Rarer are depictions of personage, telling stories
from history, battle scenes and romantic poems.
During the Quadjar dynasty there were no restrictions of representations of persons. The field of these are entirely painted
whilst the borders are printed and resist dyed. The border is especially intricate in this example showing wild animals, buildings
and people and is harking back to Safavid pictorial traditions.
In the field a lady is relaxing on a buttoned down chaise and the artist manages to give the impression of shiny leather.
It is interesting to observe the textiles shown within the textile. Qalamkari were used to tell stories and were hanging on the
walls of coffee houses or were shown by story tellers in public squares. The number two on top of it suggests that it was part
of a set of several Qalamkari each illuminating a different chapter of the tale.

Die AUSTRIA AUCTION COMPANY, Langauer GmbH (idF “AAC”)
übernimmt es, die im Vertrag aufgeführten (Kunst-)Gegenstände
im eigenen Namen für Rechnung des Einlieferers (Kommittent) als
Kommissionär in- oder außerhalb der Geschäftsräumlichkeiten,
im Internet oder unter Zuhilfenahme sonstiger, geeigneter
technischer oder tatsächlicher Einrichtungen zu den
nachfolgenden abgedruckten Bedingungen zu versteigern.
Der Einlieferer versichert, dass er allein verfügungsberechtigter
und uneingeschränkter, namentlich nicht durch Rechte Dritter
beschränkter, Eigentümer der zur Versteigerung gelangenden
Gegenstände ist bzw. berechtigt ist, im Namen eines solchen
Eigentümers zu handeln. Der Vertrag wird gemäß den
Bestimmungen der Gewerbeordnung 1994, in der jeweils
geltenden Fassung, abgewickelt.
1. Das VersteigerungsGut wird ab Einbringung in den
Lagerräumen von AAC kostenlos bis zur Abwicklung des
Versteigerungstermins aufbewahrt.
2. Die Lagerung erfolgt auf Gefahr des Einlieferers. AAC
haftet nur im Falle vorsätzlicher oder grob fahrlässiger
Vertragsverletzung. Der Beweis für Vorsatz und grobe
Fahrlässigkeit sowie sofortige Schadensmeldung obliegt dem
Einlieferer. AAC schließt deshalb zu Lasten des Einlieferers eine
Versicherung gegen Feuer, Einbruch und Diebstahl ab. Die Höhe
der Prämie wird gesondert ausgewiesen. AAC tritt mit Abschluss
dieses Versteigerungsvertrags seine Ansprüche gegen die
Versicherungsgesellschaft an den Einlieferer ab. Der Einlieferer
nimmt diese Abtretung an.
3. Die Gegenstände werden nach Maßgabe der beigefügten
Allgemeinen Versteigerungsbedingungen zugeschlagen, die
integrierender Bestandteil dieses Versteigerungsvertrags
sind. AAC kann bei limitierten Gegenständen im Namen des
Einlieferers bis zum Limitpreis mitbieten. Soweit der Einlieferer
einen Mindestpreis (Limit) nicht festgesetzt hat, erteilt der
Versteigerer den Zuschlag nach pflichtgemäßem Ermessen. Bei
Zuschlag unter Vorbehalt bleibt der Bieter nur drei Wochen lang
an sein Gebot gebunden. Der Einlieferer hat seine Entscheidung
so rechtzeitig zu übermitteln, dass der Bieter bei gewöhnlicher
Geschäftsabwicklung noch innerhalb der genannten Frist
verständigt werden kann. Kompensierung der von einem
Einlieferer für mehrere Gegenstände festgesetzten Limite ist
gestattet.
4. Im Katalog wird als Richtpreis, welchem der Einbringer,
wenn er diesem nicht binnen 3 Tagen ab Einbringung
schriftlich widerspricht, ausdrücklich zustimmt, der von AAC
unter Anwendung der gebotenen Sorgfalt, aber nach freiem
Ermessen ermittelte Schätzwert angegeben, der in keinem
Fall die Zusicherung einer bestimmten Eigenschaft oder eines
Bestimmten Wertes darstellt. AAC übernimmt diesbezüglich
keinerlei Haftung, inbes, auch keine Haftung nach den Maßstäben
der §§ 1299f ABGB. Der Einlieferer verzichtet ausdrücklich auf
Schätzungen oder BeGutachtungen durch öffentlich bestellte und
vereidigte Sachverständige.
5. Der Einlieferer belässt die in der Auktion nicht verkaufte
Ware drei Wochen nach Schluss der Versteigerung bei AAC zum
freihändigen Verkauf. Verkaufspreis ist in diesem Fall der vom
Einlieferer bestimmte Mindestpreis (Limit), ersatzweise der von
AAC nach pflichtgemäßem Ermessen bestimmte Preis.
6. Der Einlieferer weist AAC an, den ihm zustehenden Erlös
nach den Bestimmungen dieses Vertrages abzurechnen und
auszuzahlen. Umsatzsteuerpflichtige Einlieferer erhalten
zusätzlich die gesetzliche Mehrwertsteuer ausbezahlt, sobald die
Bestätigung über die pflichtgemäße Abführung an das Finanzamt
vorliegt und dies im Vertrag geregelt ist.
7. AAC ist berechtigt, die in der Versteigerung bzw. durch
Freihandverkauf nicht veräußerte Ware nach Ablauf von 5
Wochen ab Schluss der Versteigerung für Rechnung und Gefahr
des Einlieferers einem Spediteur zur Aufbewahrung oder
Rücksendung zu übergeben, bzw. Lagergeld zu erheben.
8. AAC berechnet dem Einlieferer als Provision pro
Katalognummer die im Vertrag ausgewiesenen Provisionsätze.
Abbildungen werden in den Katalog nur auf Grund besonderer
Vereinbarungen und gegen gesonderte Vergütung aufgenommen.
Der Einlieferer hat AAC außerdem die reinen Barauslagen für
Verpackung, Porti, Transporte sowie die Kosten der auf Grund
von Sonderabmachungen vorgenommenen Reparaturen und
eingeholten Gutachten zu erstatten. VersteigerungsGut, das der
Einlieferer selbst oder durch einen Dritten für sich ersteigert hat,
gilt als an Fremde veräußert.
9. AAC behält sich vor, bei Nichtveräußerung des Gutes als
pauschalierten Aufwendungsersatz 3% aus dem Limitpreis,
ersatzweise der von AAC nach pflichtgemäßem Ermessen
bestimmte Preis zuzüglich der in Ziffer 8. aufgeführten Kosten zu
berechnen.

10. Der Einlieferer übernimmt die volle Gewähr für die von ihm
bezüglich der (Kunst-)Gegenstände gemachten Angaben und stellt
AAC von allen Ansprüchen frei, die seitens Dritter aus Anlass der
Versteigerung geltend gemacht werden. Insbesondere haftet der
Einlieferer für alle Sach- und Rechtsmängel der zur Versteigerung
übergebenen Sachen. Sollten sich bei Bearbeitung der
eingelieferten Gegenstände wesentliche Mängel herausstellen, ist
AAC berechtigt, vom Vertrag zurückzutreten, wie AAC grundsätzlich
berechtigt ist die Übernahme von Gegenstände ohne Angabe von
Gründen abzulehnen. Im Falle eine Rechtsverfolgung verpflichtet
sich der Einlieferer sämtliche Kosten und Gebühren in voller Höhe
zu bevorschussen und zu tragen, soweit AAC eine diesbezügliche
Zahlungsverpflichtung trifft. AAC haftet dem Einlieferer nur im Falle
vorsätzlicher oder grob fahrlässiger Pflichtverletzung.
11. Nach vollständigem Eingang des Kaufpreise und Ablauf von
sieben Werktagen nach Zahlungseingang, frühestens jedoch
fünfundvierzig Tage nach dem Auktionstag erhält der Einlieferer
die Abrechnung und, vorausgesetzt der Kaufpreis ist bis dahin
vollständig bei AAC eingegangen, das ihm zustehende Guthaben
ausbezahlt. Verrechnungen / Gegenrechnungen / Aufrechnungen
mit anderen Forderungen von AAC gegen den Einlieferer sowie
der Abzug der dem Versteigerungshaus geschuldeten Provision,
sonstiger Kosten und barer Auslagen (vgl. Ziffer 8.) ist zulässig.
Kommt der Ersteigerer seinen Zahlungspflichten nicht, nicht
vollständig und/oder nicht fristgerecht nach, so ist AAC berechtigt,
diese im eigenen Namen, aber auf Kosten des Einlieferers
mit dessen Zustimmung, gerichtlich geltend zu machen und
Zahlung an sich zu verlangen sowie Verzugszinsen zu berechnen.
AAC haftet dem Einlieferer in Höhe des ihm zustehenden
Versteigerungserlöses erst nach Aushändigung des eingelieferten
Kunstgegenstandes an den Ersteigerer.
12. Der Vertrag ist bis zum Ablauf von einem Monat nach dem
Ende der vorgesehenen Versteigerung einseitig unwiderruflich
geschlossen. Wird er auf Verlangen des Einlieferers im
beiderseitigen Einvernehmen aufgehoben, so hat der Einlieferer
an AAC außer den Barauslagen die oben genannte Vergütung und
auch das entgangene Aufgeld des Ersteigerers als pauschalierten
Aufwandsersatz zu zahlen. Wird der Vertrag auf Verlangen von AAC
im beiderseitigen Einvernehmen aufgehoben, so hat der Einlieferer
an AAC die in Ziffer 8. bezeichneten Auslagen und Kosten zu zahlen.
Der Berechnung sind die vom Einlieferer genannten Mindestpreise
(Limite), ersatzweise die von AAC ermittelten Estimates zugrunde
zu legen.
13. Zwischen den Parteien besteht Einigkeit, dass der Einlieferer
von Ort und Zeit der Versteigerung benachrichtigt ist.
Vereinbarungen und Änderungen dieser Bedingungen bedürfen
der Schriftform. Erklärungen von AAC sind nur verbindlich, wenn
sie schriftlich bestätigt werden. Erfüllungsort und Gerichtsstand,
sofern er vereinbart werden kann, ist Wien bzw. das sachlich
und örtlich zuständige Gericht in Wien. Es gilt österreichisches
Recht. Für Konsumenten iSd KSchG gilt diese Vereinbarung nur
insoweit, als sie in Österreich weder einen Wohnsitz, noch ihren
gewöhnlichen Aufenthalt, noch eine inländische Beschäftigung
haben und keine sonstigen Bestimmungen entgegenstehen. Das
UN-Übereinkommen über Verträge über den internationalen
Warenverkauf von 11.04.1980 (CISG; BGBI 89 II) findet keine
Anwendung.
14. Falls ein Urheberrecht geltend gemacht wird und beglichen
werden muss, ist der Einbringer/Auftraggeber, für dessen Rechnung
weiter veräußert worden ist, zur Rückerstattung verpflichtet.
15. Sollte eine der Bestimmungen ganz oder teilweise unwirksam
sein oder werden, bleibt die Gültigkeit der übrigen davon
unberührt. Die unwirksame Bestimmung ist durch eine wirksame
zu ersetzen, die dem wirtschaftlichen Gehalt und Zweck der
unwirksamen Bestimmung am nächsten kommt.
16. Das „Copyright“, die Bildrechte aller zur Auktion
übernommenen Gegenstände verbleibt ausnahmslos bei AAC.
Die Verwendung, Vervielfältigung oder jegliche Weitergabe an
Dritte ist ohne schriftliche Zustimmung von AAC untersagt.

1.AUSTRIA AUCTION COMPANY, Langauer GmbH im Folgenden
“Versteigerer”) versteigert öffentlich als Kommissionär im
eigenen Namen und für Rechnung der Einlieferer (im folgenden
“Kommittenten”), die unbenannt bleiben, unter Zugrundelage der
hier genannten Allgemeinen Versteigerungsbedingungen sowie
der zuvor genannten Allgemeinen Geschäftsbedingungen. Die
Versteigerung ist freiwillig.
2. Die im Katalog aufgeführten Preise sind Schätzpreise, keine
Mindestzuschlagspreise (Limite).
3. Jeder Bieter kauft im eigenen Namen und auf eigene Rechnung,
es sei denn er weist vor Beginn der Versteigerung eine schriftliche
Vertretungsvollmacht nach. Schriftliche oder telefonische Gebote
müssen spätestens 24 Stunden vor der Auktion vorliegen und
den Gegenstand unter Anführung der Katalognummer und des
gebotenen Preises, der sich als Zuschlagsbetrag ohne Aufgeld
und Umsatzsteuer versteht, benennen; Unklarheiten oder
Ungenauigkeiten gehen zu Lasten des Bieters; im Zweifel gilt die
Katalognummer.
Bei telefonischen Geboten kann nicht dafür eingestanden
werden, dass eine Verbindung zustande kommt. Für Telefonbieter
ist der untere Schätzpreis das Mindestgebot.
Aufgrund der rechtlichen Unsicherheiten kann für die
Berücksichtigung von Geboten per E-Mail keine Haftung
übernommen werden. Durch Abgabe eines Gebotes bestätigt der
Bieter sowohl sich über den Gegenstand der Auktion vollständig
informiert als auch dessen Übereinstimmung mit den Angaben
dazu kontrolliert zu haben. AAC behält sich ausdrücklich das
Recht vor Gebote, in welcher Art & Wiese auch immer, ohne
Angabe von Gründen abzulehnen.
4. Der Versteigerer behält sich vor, Katalognummern zu
verbinden, zu trennen, außerhalb der Reihenfolge des Katalogs
aufzurufen oder zurückzuziehen. Der Aufruf kann zum
halben Estimate erfolgen, es sei denn, dass bereits höhere
schriftliche oder telefonische Gebote vorliegen. Gesteigert
wird nach Ermessen des Versteigerers in der Regel um 10% des
Ausrufungspreises bzw. des letzten gültig abgegebenen Gebots.
5. Der Versteigerer kann sich den Zuschlag vorbehalten oder
verweigern, wenn ein besonderer Grund vorliegt. Wenn mehrere
Personen dasselbe Gebot abgeben und nach dreimaligem
Aufruf kein höheres Gebot erfolgt, entscheidet das Los. Hat
der Versteigerer ein rechtzeitig abgegebenes höheres Gebot
übersehen und hat dies der Bieter sofort beanstandet oder
bestehen sonst Zweifel über den Zuschlag, kann der Versteigerer
bis zum Abschluss der Auktion nach seiner Wahl den Zuschlag
zugunsten eines bestimmten Bieters wiederholen oder den
Gegenstand erneut ausbieten. In diesen Fällen erlischt der
vorangegangene Zuschlag. Wenn trotz abgegebenen Gebots kein
Zuschlag erteilt worden ist, haftet der Versteigerer dem Bieter
nur bei Vorsatz oder grober Fahrlässigkeit.
6. Der Zuschlag wird erteilt, wenn nach dreimaligem Aufruf
eines Gebotes kein Übergebot abgegeben wird. Der Versteigerer
kann unter Vorbehalt oder unter Angabe von Bedingungen
zuschlagen, insbesondere dann, wenn das vom Kommittenten
genannte Limit nicht erreicht ist. In diesem Fall ist der Bieter
auf die Dauer von drei Wochen an sein Gebot gebunden. Erhält
er nicht innerhalb dieser Frist die vorbehaltlose Annahme
seines Gebots, so erlischt der Zuschlag. Wird das Gebot nicht
angenommen oder bietet jemand das Limit, kann der Gegenstand
ohne Rückfrage bei dem Bieter des Vorbehalts an einen höher
Bietenden abgegeben werden. Es ist Sache des Vorbehaltsbieters,
sich über die Genehmigung seines Gebots zu informieren. Für
das Wirksamwerden des Zuschlags genügt die Absendung der
Benachrichtigung an die vom Bieter genannte Adresse.
7. Bei Veräußerung von Auktionsloten in Internetauktionen
gelten die allgemeinen Geschäftsbedingungen des Betreibers der
jeweiligen Internet-Plattform. Wenn in den Bestimmungen des
Betreibers der jeweiligen Internet-Plattform für einen bestimmten
Fall keine Regelungen enthalten sind, gelten subsidiär die in den
gegenständlichen Geschäftsbedingungen enthaltenen Regeln
sinngemäß. Wenn sowohl den Bestimmungen des Betreibers
der jeweiligen Internetplattform als auch in gegenständlichen
allgemeinen Geschäftsbedingungen für einen bestimmten Fall
Regeln enthalten sind, die einander jedoch widersprechen, so
gelten im Zweifel jene Regelungen die in den Bestimmungen der
allgemeinen Geschäftsbedingungen des Betreibers der jeweiligen
Internetplattform enthalten sind. Außerdem übernimmt AAC
keinerlei Haftung für Schäden, welche Bietern oder Dritten aus
der Nutzung der Dienste von AAC entstehen. Insbesondere
haftet AAC nicht für Schäden, die darauf beruhen, dass,
infolge technischer oder sonstiger Mängel(z.B.: Stromausfall,
Systemausfall, etc), von Bietern abgegebene Gebote nicht oder
nicht rechtzeitig bei AAC eingehen oder nicht berücksichtigt
werden.
8. Der Zuschlag, der zugleich Vertragsabschluss ist, verpflichtet
den Ersteigerer zur Abnahme und umgehenden Zahlung;
unmittelbar mit Zuschlagserteilung geht die Gefahr für nicht zu
vertretende Beschädigungen, Verluste, Verwechslungen etc. der
versteigerten Sache auf den Ersteigerer über, der auch die Lasten
trägt.

9. Es wird, je nach Vorgabe des Kommittenten, differenz- oder
regelbesteuert verkauft, dies ist vor der Auktion mitzuteilen.
Bei Differenzbesteuerung wird auf den Zuschlagpreis ein
Aufgeld von 25 % erhoben, in dem die Umsatzsteuer ohne
separaten Ausweis enthalten ist. Für Unternehmer, die zum
Vorsteuerabzug bei Kunst und Antiquitäten berechtigt sind,
kann die Regelbesteuerung angewendet werden. Bei der
Regelbesteuerung besteht der Kaufpreis aus Zuschlagpreis
und 21 % Aufgeld. Auf diesen Betrag wird die jeweils gültige,
gesetzliche Umsatzsteuer hinzugerechnet. Lieferungen
an umsatzsteuerpflichtige Unternehmen mit Sitz in einem
Mitgliedsland der Europäischen Union (ausgenommen
Lieferungen an in Österreich ansässige Unter¬nehmen und
differenzbesteuerte Objekte) unterliegen der Erwerbsteuer im
jeweiligen Bestimmungsland. In diesem Fall ist die Lieferung
der Objekte in Österreich umsatzsteuerfrei, wenn AAC vor dem
Zuschlag die gültige Umsatzsteueridentifikationsnummer (UID)
des Ersteigerers bekanntgegeben wird. Für Nachverkäufe wird
eine um 2 % erhöhte Käufergebühr verrechnet. Werden die
ersteigerten Gegenstände vom Ersteigerer an eine Adresse in
Drittländern (außerhalb der EU) ausgeführt, wird diesem die
gezahlte Mehrwertsteuer erstattet, sobald der Käufer dem
Versteigerer den Ausfuhrnachweis vorgelegt hat. Der Kaufpreis
ist jedenfalls mit dem Zuschlag fällig. Während oder unmittelbar
nach der Auktion ausgestellte Rechnungen bedürfen der
Nachprüfung; Irrtümer bleiben vorbehalten.
10. Zahlungen sind in bar in EURO (€) an den Versteigerer zu
leisten. Alle Arten unbarer Zahlungen werden nur aufgrund
besonderer Vereinbarung erfüllungshalber angenommen; für
rechtzeitige Vorlegung, Protestierung, Benachrichtigung oder
Zurückleitung nicht eingelöster Zahlungen/Zahlungsmittel
haftet der Versteigerer nicht. Hat sich der Versteigerer mit
unbarer Zahlung einverstanden erklärt, gehen alle dadurch
ausgelösten Kosten, Steuern und Gebühren der Zahlung (inkl.
der dem Versteigerer abgezogenen Bankspesen) zu Lasten
des Ersteigerers. Der Versteigerer ist nicht verpflichtet, den
zugeschlagenen und ersteigerten Gegenstand vor vollständiger
Bezahlung (bei unbarer Zahlung erst nach vorbehaltloser
BankGutschrift) aller vom Käufer geschuldeten Beträge
herauszugeben. Das Eigentum bleibt bis zur Erfüllung aller
im Zeitpunkt des Zuschlags gegen den Käufer bestehenden
Forderungen des Versteigerers vorbehalten. Der Käufer kann
gegenüber dem Versteigerer nur mit unbestrittenen oder
rechtskräftig gerichtlich festgestellten Forderungen aufrechnen.
Zurückbehaltungsrechte des Käufers sind ausgeschlossen, soweit
sie nicht auf dem selben Vertragsverhältnis beruhen.
11. Bei Zahlungsverzug werden Zinsen in Höhe von 1% je
angebrochenem Monat berechnet. Der Versteigerer kann bei
Zahlungsverzug wahlweise Erfüllung des Kaufvertrages oder
nach erfolglosem Ablauf einer angemessenen Nachfristsetzung
Schadensersatz wegen Nichterfüllung verlangen. Der
Schadensersatz kann in diesem Falle auch so berechnet werden,
dass die Sache nochmals versteigert wird und der säumige
Käufer für einen Mindererlös gegenüber der vorangegangenen
Versteigerung und für die Kosten der wiederholten Versteigerung
einschließlich des Aufgeldes einzustehen hat. Zu einem
neuen Gebot wird der Käufer nicht zugelassen und hat auf
einen Mehrerlös keinen Anspruch. AAC ist im Falle eines
Kommissionsverkaufes berechtigt, diese Forderungen nach
Maßgabe der gesetzlichen Kommissionsbestimmungen an den
Einbringer abzutreten. Im Falle eines Deckungsverkaufes oder der
Wiederversteigerung für den Käufer durch AAC wird der Käufer
hinsichtlich der dabei zur Anwendung gelangenden Gebühren wie
ein Einbringer behandelt.
12. Der Käufer ist verpflichtet, seine Erwerbung unverzüglich
nach der Auktion abzuholen. Gerät er mit dieser Verpflichtung in
Verzug und erfolgt die Abholung trotz Mahnung nicht, kann der
Versteigerer Verzugsschadenersatz verlangen mit der Maßgabe,
dass er den Gegenstand nochmals versteigern und seinen
Schaden in derselben Weise wie beim Zahlungsverzug berechnen
kann. Ab dem Zuschlag lagert der versteigerte Gegenstand
auf Rechnung und Gefahr des Käufers beim Versteigerer, der
berechtigt, aber nicht verpflichtet, ist eine Versicherung zu
Lasten des Käufers abzuschließen oder sonstige wertsichernde
Maßnahmen auf Kosten und zu Lasten des Käufers zu ergreifen.
Er darf jederzeit nicht abgeholte Objekte im Namen und auf
Rechnung des Käufers bei einem Dritten einlagern. Bei einer
Selbsteinlagerung durch den Versteigerer kann dieser die
Zahlung eines üblichen Lagerentgelts (zzgl. Bearbeitungskosten)
verlangen. Der Versand und die Verpackung erfolgt nur auf
Wunsch und nach den Anweisungen des Käufers und auf dessen
Kosten und Gefahr.
13. Sämtliche zur Versteigerung gelangenden Gegenstände
können vor der Auktion besichtigt und geprüft werden. Sie
sind gebraucht und werden, wie gesehen, ohne Haftung des
Versteigerers für Sachmängel und unter Ausschluss jeglicher
Gewährleistung zugeschlagen. Die Katalogangaben, die nach
bestem Wissen und Gewissen erstellt wurden, sind keinerlei
Garantien im Rechtssinne (§§ 922 ff ABGB) und dienen
ausschließlich der Information; sie werden nicht Bestandteil
der vertraglich vereinbarten Beschaffenheit. Gleiches gilt für
Auskünfte jeglicher Art (Zustandsbeschreibung), sei es mündlich
oder schriftlich. Der Erhaltungszustand wird im Katalog nicht

durchgängig erwähnt, so dass fehlende Angaben ebenfalls keine
Beschaffenheitsvereinbarung begründen; alle Gegenstände
werden in dem Erhaltungszustand veräußert, in dem sie sich bei
Erteilung des Zuschlags befinden.
14. Der Versteigerer verpflichtet sich jedoch bei Abweichungen
von Katalogbeschreibungen, welche den Wert oder die
Tauglichkeit aufheben oder nicht unerheblich mindern, und
welche innerhalb einer Verjährungsfrist von einem Jahr nach
dem Zeitpunkt des Zuschlags in begründeter Weise vorgetragen
werden, seine Rechte gegenüber dem Einlieferer, nötigenfalls
auch gerichtlich, geltend zu machen. Im Falle erfolgreicher
Inanspruchnahme des Einlieferers erstattet der Versteigerer dem
Käufer ausschließlich den Kaufpreis, jedoch keine sonstigen dem
Käufer entstandenen Kosten und Aufwendungen. Im Übrigen ist
eine Haftung des Versteigerers wegen Mängeln ausgeschlossen.
15. Der Einbringer ist berechtigt, gegen Zahlung eines
vereinbarten Entgelts im Falle der Zurückziehung (vgl. Pkt. 12
der AGB), den eingebrachten Gegenstand bis 1 Monat vor dem
geplanten Versteigerungsbeginn zurückzuziehen.
16. Ansprüche auf Schadensersatz aufgrund eines Mangels, eines
Verlustes oder einer Beschädigung des versteigerten Objektes,
gleich aus welchem Rechtsgrund, oder wegen Abweichungen
von Katalogangaben oder anderweitig erteilten Auskünften sind
ausgeschlossen, sofern der Versteigerer Konsumenten gegenüber
nicht vorsätzlich oder grob fahrlässig, Unternehmen gegenüber
nur vorsätzlich, gehandelt oder vertragswesentliche Pflichten
verletzt hat; im übrigen gilt Ziffer 12. Für Schäden, die durch
Naturereignisse oder höhere Gewalt entstehen, für Schäden
die sich als Folge längerer Lagerung ergeben sowie für Schäden
infolge einer Zurückziehung gem. voranstehendem Pkt. 14
oder entgangenen Gewinn übernimmt AAC keine Haftung. AAC
haftet dem Käufer eines Gegenstandes für den Verlust oder die
Beschädigung desselben bei grobem Verschulden, gegenüber
Unternehmern jedoch nur bei mindestens krasser grober
Fahrlässigkeit seiner Bediensteten bis zur Höhe des bezahlten
Kaufpreises (Versicherungswert gegenüber dem Käufer), dem
Einbringer gegenüber bis zur Höhe des Versicherungswertes.
Versicherungswert ist das Limit, oder 120% des AusStarting Bides,
wenn kein Limit vereinbart wurde.
17. Zugunsten aller AAC gegenüber dem Einbringer gegenwärtig
oder zukünftig, befristeten oder noch nicht fälligen, zustehenden
Forderungen, macht AAC an allen von diesem eingebrachten
Gegenständen ein Pfandrecht geltend, welches sich auf
Schadenersatzforderungen sowie alle erdenklichen damit
in Zusammenhang stehende Kosten und Gebühren, inkl. der
Kosten der rechtsfreundlichen Vertretung erstreckt. AAC ist
daher berechtigt jene Gegenstände, an denen ein Pfandrecht
entstanden ist, ohne weitere Information und Verständigung des
Einbringers in Entsprechung der gesetzlichen Bestimmungen zu
verwerten. Gleiches, ohne Einschränkung, gilt für alle Sachen
eines Käufers.
18. Erfüllungsort und Gerichtsstand, sofern er vereinbart werden
kann, ist Wien. Es gilt ausschließlich österreichisches Recht. Das
UN-Übereinkommen über Verträge über den internationalen
Warenkauf vom 11.04.1980 (CISG; BGBl 89 II) findet keine
Anwendung. Sollte eine der Bestimmungen ganz oder teilweise
unwirksam sein oder werden, bleibt die Gültigkeit der übrigen
davon unberührt. Die unwirksame ist durch eine wirksame
zu ersetzen, die dem wirtschaftlichen Gehalt und Zweck der
unwirksamen Bestimmung am nächsten kommt.
19. Diese Versteigerungsbedingungen gelten entsprechend auch
für den nachträglichen freihändigen Verkauf von Gegenständen
durch den Versteigerer an einen Erwerber.
20. Ohne ausdrückliche schriftliche Zustimmung der Betroffenen
werden Personaldaten, soweit nicht eine gesetzliche
Verpflichtung besteht oder begründete Ansprüche von dritter
Seite an einem Versteigerungsgegenstand geltend gemacht
werden, nicht bekanntgemacht. Im Falle der Geltendmachung von
begründeten Ansprüchen dritter Seite ist AAC berechtigt dieser
Seite (i) die Personaldaten des Einbringers des Gegenstandes oder
(ii) die Daten einer beabsichtigten gerichtlichen Hinterlegung gem.
§ 1425 ABGB bekannt zu machen. AAC ist bis auf jederzeitigen
schriftlichen Widerruf berechtigt die von Einbringer und Käufer
bekannt gemachten und erfassten Daten elektronisch zu
verarbeiten und zum Zwecke der internen Marktforschungs-,
Marketing- und werbezwecke zu erheben, zu bearbeiten, zu
speichern und zu nutzen. Die Einbringer und Käufer stimmen
weiter der Zusendung von Werbematerial durch AAC ausdrücklich
zu. Auch diese Zustimmung kann jederzeit schriftlich mit Fax, Post
oder per e-Mail widerrufen werden.

GENERAL TERMS AND CONDITIONS
for Austria Auction Company Udo Langauer
AUSTRIA AUCTION COMPANY Langauer GmbH (AAC) accepts
objects on behalf of sellers as a commission sale in or
outside its business premises, the Internet or by using other,
appropriate technical or actual equipment, to auction such
goods subject to the following Conditions. The consignor
warrants he is the sole owner of the items to be auctioned, or
is duly authorized to act on behalf of such owner. The contract
will be in accordance with the provisions of the Austrian
Commercial Code of 1994 as currently amended.
1. The auction item will be stored in the storerooms of AAC for
free until the completion of the auction for which the objects
have been accepted.
2. The storage is at the risk of the consignor. AAC is only liable in
case of willful or grossly negligent breach of contract. Any proof
for intent and gross negligence must be made by written claim
immediately by the consignor. However, for the following -- fire,
burglary and theft -- AAC offers insurance at the consignor’s
expense. The premium for this insurance will be shown
separately on the invoice. At the completion of the auction this
insurance expires. The consignor accepts these Conditions in
writing at the time of consignment.
3. The consignor agrees the sale of consigned objects will be
governed in accordance with the attached General Terms and
Condition of Auction, which are an integral part of this auction
contract. AAC can in certain circumstances bid on behalf of
the consignor up to the reserve price. Where the consignor
has not set a minimum price (the reserve), the auctioneer shall
sell the object at a price at its sole discretion. If the object
is unsold during the auction, the highest bidder will be tied
to his bid for a period of three weeks. The consignor has to
agree to such a sale, to the highest bidder, in sufficient time
so that bidder can be notified within the three week period. If
the consignor gives a group of objects for sale the auctioneer
has the right to sell them at his sole discretion as long as the
consignor’s limit for the group is met.
4. If three days from the date of accepting the consignment
agreement the consignor has not contacted AAC, the
consignor then agrees to the Estimate in the AAC consignment
agreement. These Estimates done by AAC using due care
are not any guarantee of selling price. AAC does not assume
any responsibility to be held liable by the standards of Civil
Code § § 1299f. The consignor expressly agrees to waive any
Estimates or assessments made by outside publicly appointed
and sworn experts.
5. After the close of the auction, the consignor agrees to leave
any unsold objects with ACC for a period of three weeks to allow
AAC to arrange possible private sales. Selling price in this case will
be a minimum determined by the consignor’s reserve. If there is
no reserve consignor agrees to allow AAC to sell the object at a
price determined by AAC’s sole discretion.
6. The consignor agrees to be paid according to the terms of this
contract. Should the consignor be a corporation the consignor
agrees to pay on its behalf the VAT it will receive from AAC as part
of its settlement for the object’s sale.
7. Consignor agrees if the object is not sold or picked up within
five weeks from the date of sale AAC is entitled to either return
the object at consignor’s cost and risk, or to charge storage fees at
industry standard.
8. Consignor agrees to pay AAC a commission based on the
consignment agreement. Consignor agrees to pay for any images
in the catalog according to the consignment agreement. Consignor
agrees to pay any expenses related to the sale of his objects, like
packing, postage, transportation and the cost of repairs, etc., listed
in the consignment agreement. Should the consignor, or his agent,
bid for and buy any object listed on the consignment agreement
with AAC consignor agrees to pay all normal charges, as if the object
was sold to any other bidder.
9. AAC reserves the right to charge a 3% commission, plus any
costs listed in paragraph 8 of this agreement, for any object which
has remained unsold in the auction or in the three week period
following the auction.
10. The consignor takes full responsibility for the information he has
provided AAC about the object and guarantees to protect AAC from
any and all claims by any third party. In particular, the consignor
shall be liable for all defects and deficiencies of the objects. Should
AAC discover any additional significant defects after delivery AAC
is entitled to cancel the contract. Also in principle AAC is entitled to
reject accepting the object without giving any reason. In the event
of any contest of ownership or anything else the consignor agrees
to pay all expenses in advance. AAC is liable to the consignor only in
case of willful or grossly negligent breach of duty.
11. Forty-five days after the auction, providing the buyer has paid
in full, the consignor will be paid the balance due by AAC. If the
buyer does not pay in full, at the consignor’s discretion, AAC will
endeavor to collect payment. However, the consignor agrees to pay
in advance for any fees or charges associated with this effort. AAC is
liable to the consignor for the amount of the auction proceeds due
to him when the buyer has paid in full.

CONDITIONS OF AUCTION
for Austria Auction Company, Langauer GmbH
1. Austria Auction Company Langauer GmbH (Auctioneer) conducts public
auctions as a commission agent in its own name and on behalf of the
consignor, who will remain anonymous in public, under the terms and
Conditions listed in the Terms and Conditions and below.
2. The prices listed in the catalog are only Estimates.
3. Each bidder buys in his own name and for his own account, unless prior to
the auction other arrangements have been made in writing, or by a written
power of attorney. Written or telephone bids must be arranged in advance,
but not less than 24 hours before the date and time of auction. This must
be done in the name of the bidder, citing the catalog number and maximum
bid (hammer price), which is understood to be an aggregate amount without
charges and sales tax (hammer price). For telephone bidders the lower
estimate is the minimum bid. All errors, mistakes and inaccuracies will be
borne by the bidder, in case of doubt the catalog number is the determinant.
AAC shall not be held liable for any problems with any telephone bid or
email bid. By placing a bid, the bidder confirms agreement with all Terms
and Condition listed here and in the Terms and Condition in the catalog. AAC
expressly reserves the right to reject any bid without reason.
4. The auctioneer reserves the right to combine catalogue numbers, to sell
out of sequence, to withdraw any lot, or to cancel the sale without reason.
The bidding can begin at any amount at AAC’s discretion. Bidding will be
increased by approximately 10%, or at any amount at the discretion of AAC.
5. AAC can refuse any bid at its discretion. If several bidder make the same bid
simultaneously, and after three unsuccessful attempts to raise the bid, AAC
at its discretion will decide who will win the lot. Should a bidder immediately
complain about a missed bid, or raise immediate questions about the selling
of a lot, AAC has the right to reoffer the lot. In any case AAC shall only be liable
for gross negligence.
6. The buyer will win a lot only after three unsuccessful calls for a higher bid
have been made. AAC can close the bidding at any time and announce a lot is
unsold. In such a case the highest bidder of record will be bound for a period
of three weeks to honor his bid. If that bidder does not receive, within that
period, the unConditional acceptance of that bid, this contract expires. If
during that period there is a higher bid AAC can accept it. At AAC’s discretion
it will notify the bidder of the receipt of a higher bid to allow the bidder to
raise his bid accordingly. AAC will use the bidder’s registered address for
notification but in no event will AAC be bound to make any such notification.
7. Consignor and buyer agree any sale completed on any associated Internet
platform will be governed by the terms and Conditions of the operator of that
platform. If there are no terms and Conditions on that platform then those
of AAC will apply. Consignor and buyer agree if there are conflicting terms
and Conditions between AAC and the operator of an internet platform then
those of AAC will apply. Consignor and buyer agree AAC assumes no liability
for damages of any kind arising when bidders or third parties use the services
12. Should an object stay unsold in the auction and the
consignor demands it returned before the end of the three
week period, AAC is entitled to receive full commission and
any other relevant charges before returning the object. If
the contract is canceled by mutual agreement between
the consignor and AAC, the consignor agrees to pay AAC all
commission and costs. The calculation for this will be from the
minimum price specified in the consignment agreement, or as
alternatively set by AAC in the catalog.
13. The consignor agrees to the listed date and time of the
auction shown in the consignment agreement. All changes and
any amendments to these Conditions of sale must be registered
in writing. Statements by AAC are only binding if they are
confirmed in writing. Consignor and buyer agree the jurisdiction
of the local court in Vienna will apply. In any event only Austrian
law applies. Consignor and buyer agree the UN Convention on
Contracts for the International Sale of Goods of 11.04.1980
(CISG 89 BGBl II) shall not apply.
14. Consignor agrees if there is any copyright question the
consignor will be liable for all charges and payments.
15. Should any part of this agreement be found invalid it does
not change any of the other parts. Consignor agrees if any
invalid part of this agreement is replaced AAC has the sole right
for its agreement.
16. The “Copyright”, the image rights of all items taken for
auction remains without exception with AAC.
The use, reproduction, or any disclosure to third parties without
the written permission of AAC is prohibited.

of AAC. In particular, AAC is not liable for any damages due to any technical or
other defects (e.g. power failure, system failure, etc.).
8. The consignor and buyer agree the winning bid is a contract and the buyer is
committed to purchase and pay promptly. The consignor and buyer agree AAC
assumes no responsibility for any damage, loss, confusion, etc. in delivering the
successfully sold object to the buyer.
9. Consignor and buyer agree objects will be sold by AAC under the differential
tax rules. AAC’s 25% premium only includes the VAT of the differential tax. For
corporations who have a pre-tax allowance the 21% remains, and in addition
a 20% VAT charge of the total amount will be added. If an EEC company
operating outside of Austria is the buyer then the sale is subject to the transfer
tax of that country. In this case where no Austrian VAT is to be paid the buyer
must notify AAC prior to the sale in writing and include its VAT identification
number (UID). If the buyer is located outside of the EEC then the VAT will be
refunded only if the buyer provides AAC with proof of proper export. The buyer
agrees to pay for any and all objects successfully purchased at the auction
immediately after the last lot is sold unless prior payment arrangements
have been approved in writing by AAC. For buyer wishing to settle their bill
immediately after the auction AAC will generate an invoice and the buyer must
check this for any errors and immediately bring those errors to AAC’s attention.
10. Buyer agrees to pay in Euro(€) by cash. All other forms of payment must
be agreed to by AAC prior to the beginning of the auction. Buyer agrees any
expenses related to payments will be paid by the buyer and not by AAC. Buyer
agrees AAC will not surrender the object until full payment and any other
related charges have been collected in full by AAC.
11. Buyer agrees any payment not made immediately after the auction ends
will accrue interest at the rate of 1% per month or part thereof. The auctioneer
may claim damages from the buyer for non-performance in case of default by
either breach of contract or after expiry of a reasonable grace period. Should
the buyer be deemed in default AAC at its sole discretion may re-offer the
object for sale either in private sale or by auction. The buyer agrees to pay in
addition to the original invoice any charges AAC should have to bear in reselling
the object. Should AAC sell the object for more the buyer is not entitled to
receive any excess proceeds and agrees to be considered as the consignor for
such a sale.
12. Buyer agrees to take possession of his purchase immediately after the
auction. Should the buyer fail to take possession then, or after further attempts
by AAC to notify the buyer to take possession, AAC is entitled to damage delay
compensation as in the same manner as if the buyer did not pay. Immediately
after the object is purchased under the hammer the auctioned object is stored
at the expense and risk of the buyer. The buyer agrees any undelivered object
may be store by AAC at its sole discretion and any reasonable charges for that
storage will be the responsibility of the buyer. The buyer agrees shipping and
packaging of any purchased object is on request only and at its own cost and
risk. Such arrangement must be agreed to by AAC in writing but under no
circumstances will AAC be liable for any claims of loss, damage, etc.
13. All objects offered by AAC for auction may be inspected and examined prior
to the auction at the stated time and place listed in the catalog. The object are
offered without any expressed liability or warranty by AAC. It is the buyers sole
responsibility to make an inspection and while AAC will help to do this buyer
agrees not to hold AAC responsible for any and all claims related to this help.
The catalog details have been created to the best of AAC’s knowledge and
belief, but there are no guarantees in the legal sense (§§ 922 ff Civil Code) for
this information. They are not part of any contract between AAC and the buyer
or consignor. Buyer and consignor agree all objects are sold where is and as is.
14. The auctioneer agrees if there are any gross errors in the catalog
description proven beyond reasonable doubt, which grossly devalue the
purchase, the buyer has the right within a reasonable time period and by
written notification to AAC to a refund of the purchase price (hammer)
exclusive of the refund of any other payments.
15. The consignor may withdraw any object from the auction but this must
be done by written notice to AAC prior to one month before the date of the
auction. If the consignor does this a fee equal to 25% of the high Estimate must
be paid to AAC. In no event will AAC withdraw any lot until this fee is paid in full.
16. Consignor and buyer agree not to hold AAC responsible for any claims other
than those judged to be grossly negligent.
17. Consignor grants AAC the right to place a lien on any objects should there
be any unpaid payments due AAC. Consignor agrees to be responsible for any
incidental charges related to AAC’s collecting any unpaid bill. Consignor agrees
AAC may sell any object to collect any unpaid bills according to the relevant
statutory provisions. The same, without restriction, applies to all circumstance
between AAC and a buyer.
18. Consignor and buyer agree the jurisdiction of the local court in Vienna will
apply. In any event only Austrian law applies. Consignor and buyer agree the
UN Convention on Contracts for the International Sale of Goods of 11.04.1980
(CISG 89 BGBl II) shall not apply. Should any part of this agreement be found

19. Consignor and buyer agree these terms and Conditions also apply for any
subsequent private sale of objects by AAC to any purchaser.
20. AAC will not release any consignor or buyer private information unless
there is a legal obligation or substantiated claims by third parties. In the case
of a valid claim by a third party AAC has the right to release the personal data
of the consignor or buyer. At AAC’s sole discretion any private information may
be used in its marketing and any other commercial activities. However, AAC will
not give this information to any other third parties for their use.
