Dieses immanente Spannungsverhältnis der Versammlungsleitung hat dazu beigetragen, dass insbesondere die Befugnis des Versammlungsleiters zur Zurückweisung rechtswidriger Anträge, seine Abwahl und seine Haftung in den letzten Jahren in den Fokus deutscher Hauptversammlungen gerückt sind. An dieser Stelle setzt David Maximilian Langenbach an und leistet einen Beitrag zur sachgerechten Auflösung dieser Konfliktsituationen. Hinsichtlich einer Zurückweisungsbefugnis und einer Abwahl entwickelt er Ansätze, mit deren Hilfe strittige Anträge interessengerecht gehandhabt werden können. Dabei zeigt er eine Haftung des Versammlungsleiters für fehlerhaftes Verhalten auf.Die Arbeit wurde mit dem Fakultätspreis 2018 der Universität zu Köln ausgezeichnet.
