IMPACT OF FAILURE TO CONDUCT INVESTIGATION UNDER LABOUR LAWS IN TANZANIA According to s. 37 (1) and (2) of the Employment and Labour Relations Act, Chapter 366 of the Revised Laws, termination of an employee is fair if it is based on fair reason and done in accordance with a fair procedure. Investigation must be conducted to ascertain whether there are sufficient grounds to hold a disciplinary hearing and investigation must precede the disciplinary hearing. That serves two main purposes; to ascertain the existence of the grounds for commencing a disciplinary hearing against an employee and to enable the employee to make a defense on the basis of the investigation report. Failure to carry out the investigation hence a breach of the mandatory provisions of rule 13 (1) of the Code of Good Practice, that violation denied the employee the opportunity to have the report thereof for making his informed defense.
