Zusammenfassung

Die VOB/B sieht im Gegensatz zum gesetzlichen Werkvertragsrecht eine Reihe von Ansprüchen und Rechten im Zusammenhang mit Mängeln bereits für den Zeitraum der Erfüllung, also vor Abnahme, vor. Sie sind in erster Linie gerichtet auf eine mangelfreie Herstellung des geschuldeten Werkes und – soweit dieser Zweck nicht erreicht wird – auf eine (Teil-)beendigung des Vertrages. Dies ist ein grundsätzlicher Unterschied zum Werkvertragsrecht des BGB. Auch für den Zeitraum nach der Abnahme sieht das Mängelhaftungssystem der VOB/B verschiedene Ansprüche vor, die nach Grundstruktur ebenfalls primär auf die Mängelfreiheit der Bauleistung gerichtet sind.
