Besondere Berücksichtigung findet dabei die Frage, ob die Rechtsprechung des BGH zur Haftung nach §7 StVG (Urteil des BGH vom 08. Dezember 2015 - VI ZR 139/15) für die seehandelsrechtliche Rechtslage zum Ende des Obhutszeitraums von Bedeutung ist bzw. welche Unterschiede zur Rechtslage nach dem StVG bestehen. Im Rahmen eines Stückgutfrachtvertrags (§481 ff. HGB) verpflichtet sich der Verfrachter das Gut mit einem Schiff über See zum Bestimmungsort zu befördern und dort dem Empfänger abzuliefern (vgl. §481 Abs. 1). Ähnliches gilt mit einzelnen Besonderheiten auch für den Reisefrachtvertrag (§527 Abs. 1 S. 1 HGB). Zum Zwecke der vertragsgemäßen Beförderung übernimmt der Verfrachter das Transportgut, d.h. er erwirbt in aller Regel unmittelbaren oder mittelbaren Besitz. Die Beförderung endet regelmäßig durch die Ablieferung des Transportguts an den im Frachtvertrag bestimmten Empfänger. Zwischen der Übernahme zur Beförderung und der Ablieferung des Gutes befindet sich das Gut in der Obhut des Verfrachters. Während dieses Obhutszeitraums haftet der Verfrachter gem. §498 Abs. 1 HGB für Schäden, die durch Verlust oder Beschädigung des Gutes entstehen, sofern ihn ein Verschulden trifft, das allerdings vom Gesetz vermutet und daher vom Verfrachter zu widerlegen ist.
