Just out! New book by our Swiss #IHL Chair Professor Marco Roscini
in which he dissects the principle of #nonintervention and explores what constitutes an 'intervention' in #internationallaw and when interventions are unlawful.
Drawing on an extensive array of primary documents and examining over 200 intervention cases spanning from the 18th century to the modern era – including those in #Libya, #Mali, #Iraq, #Syria, #Yemen, #SouthSudan, and #TheGambia –, the book provides a meticulous analysis of this principle and its connections to fundamental notions of international law such as #sovereignty, the #useofforce, #selfdetermination, and #humanrights protection.
The last chapter of the book also explores this principle in the information age and discusses #cyberoperations as a new means of coercion in the domestic affairs of states.

Once more, I would like to highlight that what is happening right now in Gaza and the lack of effective implementation of international humanitarian law is undermining the work of international law and order globally. The double standards applied to this conflict set a presence that will damage peace work in the MENA region and globally for many years.
For peace and conflict resolution practitioners, especially those who work on prevention and reconciliation like myself, the implication of a lack of effective implementation of international standards over citizens in Gaza will act as a disincentive for future groups to be willing to come to the negotiation table, be willing set-aside arms, be willing to negotiate because the framework that exists to do so has been undermined.
International laws and regulations have been undermined despite calls from every direction to uphold the law, calling for a cease-fire, and restoring global order over humanitarian causes by all bodies of the UN, international legal experts, medical practitioners, the most well-renowned NGOs, and numerous governments.
The implications of what this means for the rule of law over peace and security are massive not only for Gaza but for the rest of the world

Thanks, ODI for telling the world the plain truth and highlighting the failures, the double -standard, and the selective application of International law. I am glad you shed light on some of the most important failures in this article.
" Western governments are failing in their responsibility to act in the face of credible accounts of war crimes being committed in the Israeli–Hamas conflict. Calls for a ‘humanitarian pause’ are a distraction and a derogation of humanitarian responsibilities. Only a ceasefire can stop the bloodshed."
I am delighted to share the publication of my first article featured in Polemics Magazine, wherein I explore the potential strategies the international community could employ to address the Taliban's egregious violations of human rights in Afghanistan within and under international law. Legal actions targeting the Taliban, in particular crimes falling under the Rome Statue, possess the capacity to place substantial constraints on the Taliban's course of action. Moreover, the political ramifications of such actions are poised to fortify resistance against the oppressive terror regime and galvanize support for human rights. The imperative of prioritizing and adhering to international law cannot be stressed enough, particularly considering the current landscape of ongoing conflicts and the geopolitical environment that overshadow the importance of respecting basic human rights and tenets of International law.
“Since the fall of the Republic of Afghanistan in mid-August 2021 and the Taliban’s takeover, the people of Afghanistan live not only in a multiplex of dire humanitarian crisis but also in deep legal uncertainty. For the people of Afghanistan, it is totally unclear what rights, obligations, and legal remedies (if any) they have at their disposal under the rule of the terrorist group.”

Open letter from #FIDH
" [It] is fundamental that the European Union and its member states, as ardent and impartial defenders of international law, call for de-escalation and an immediate ceasefire to #protect civilian populations. It is principled from the #EU to exert pressure on Israel to open #Gaza, allow humanitarian aid in, and once and for all lift blockade; the collective punishment of the entire population in Gaza.
The EU should show #ethical leadership and refrain from double standards, and put an end to Israel’s prevailing #impunity. It is incumbent on the European Union to put an end to its unconditional support for the Israeli government, and to condemn in the strongest terms the problematic statements made by its leaders, unless it would become #complicit in the serious violations of #international#law for which Israel may be responsible. "
📣 The 27 countries of the European Union meet today to define a common position regarding the latest violent events in Palestine and Israel. FIDH urges the EU leaders to 👇
🟣 Intervene in support of international humanitarian law and human rights
🟣 Stop the targeting of civilians and call for an immediate ceasefire
🟣 Allow for humanitarian aid to enter Gaza
Read the FIDH open letter to the EU and to M. Charles Michel - President of the European Council, M. Josep Borrell Fontelles - High Representative of the European Union for Foreign Affairs and Security Policy, Ms. Ursula von der Leyen - President of the European Commission and Ms. Roberta Metsola - President of the European Parliament.
The European Union has a role to play to uphold international law, enable peace and ensure accountability.
Now is the time.
Rules of war are making headlines early on in 2024. NPR published an interesting article this week discussing the legal guidelines countries must follow when prosecuting a war. The article specifically examines the rules surrounding Israel's attacks in Gaza. Check out the article to learn more about the rules that govern how countries can legally engage in war. #RulesOfWar#InternationalLaw#NPR
